RECOMMENDATION

 

Approval to reject all bids for the Brigadoon Park Renovation Project, and authorization for the Director of Public Works to re-advertise and re-bid the project.  CEQA:  Exempt.

 

BACKGROUND

 

Brigadoon Park is located in southeast San José near the intersection of Capitol Expressway and Silver Creek Road.  The park site is bordered by Brigadoon Way, Daniel Maloney Drive and Camperdown Way (map attached).

 

The park was originally built in 1979 and consists of a tot lot, youth play area, wooden pedestrian bridge, concrete slides, volleyball area, and mounded landscape areas.  In March of 2000, an assessment and feasibility study was completed by the City’s consultant, Tom Richman and Associates, to determine the extent of renovation which could be accomplished with the available funding.  As part of the feasibility study, a community meeting was held on March 30, 2000 to gather input on the design features.  As part of the playground improvements, it was determined that the concrete slides were a unique feature to the City park system and there was a desire by the community to preserve them if possible.  The consultant completed an assessment of the slides and determined that if certain safety features were included, the slides could be renovated and be retained. 

 

It was also determined that improvements to the pathway system, pedestrian bridge, drainage improvements, and landscaping were also to be included in the project.

 

The base bid scope of work for this proposed project includes installation of a tot and youth play area with resilient surfacing, renovation of the concrete slides with new safety features, concrete walkways, drainage, irrigation, and planting improvements.

 

In addition to the base bid there are three Add Alternate items included in the project:

The low bid submitted by West Coast Engineering, Inc. was one percent under the Engineer’s Estimate.  An error was found in theThe  project specifications required test results for the engineered wood fiber for the play area to be submitted with the bid.  Boulder Rock Landscape Construction was the only bidder who submitted the test results with the bid and .  West Coast Engineering, Inc. and Lone Star Landscape, Inc. did not submit the test results.  Boulder Rock Landscape Construction has sent a letter of protest based on the failure of the other bidders to submit the test results.requesting that the project be awarded to the legal bidder or be re-bid based on submittal of the test results for the wood fiber.

 

Staff, in coordination with the Attorney’s Office, concurs that tThe two low bidders were are non-responsive based on the factbecause they failed to submit  that the test results for the wood fiber were not submitted with the bids as required by the specifications.  The third bid is excessively high. Therefore, staff recommends that the Council approve the rejection of all bids and authorize the Director of Public Works to re-advertise and re-bid the project as soon as possible.

 

PUBLIC OUTREACH

 

This proposed project was listed on the City’s Internet bid line and advertised in the San José Mercury News and San José Post Record.  Bid packages for all Department of Public Works construction projects are routinely provided to a standard list of various contractor organizations, builder’s exchanges and disadvantaged business organizations, including United Minority Business Enterprises and the San José Minority Business Development Center.

 

COORDINATION

 

This proposed project has been coordinated with the Offices of the City Attorney, Risk Manager and Equality Assurance; and the Departments of Planning, Building and Code Enforcement, General Services, and Parks, Recreation and Neighborhood Services.
