Approval of a continuation agreement for consultant services for the Alviso Ring Levee Wetland Mitigation Project with URS Corporation Americas, extending the term from May 1, 2000 to December 31, 2002, and increasing the amount of compensation by $21,000, for a total agreement amount not to exceed $320,000.
BACKGROUND
In 1991, the City of San José, A. J. Raisch Paving Company (Raisch) and the United States Environmental Protection Agency (EPA) entered into a Consent Decree to remove the Alviso Ring Levee (Levee) and perform wetland mitigation and restoration work in the New Chicago Marsh in Alviso (map attached). The primary objective of the mitigation and restoration work is to create seasonal wetlands to replace the functions, values and losses over time of the wetlands affected by the placement of the levee in 1983.
On March 30, 1993, the City entered into an agreement with an environmental engineering consultant, URS Corporation Americas (formerly known as Woodward-Clyde Consultants), to prepare project plans and specifications for the wetland mitigation and restoration project, and to assist during the construction phase. An amendment to the agreement was approved on September 24, 1996 for a term to expire on April 30, 2000.
ANALYSIS
The mitigation and restoration improvements were completed in 1997. Under the Consent Decree, the City is to maintain and monitor the wetland sites for a maximum of five years. The first two years were mandatory and third through the fifth years were at the option of the Army Corp of the Engineers. The Army Corps of Engineers has asked the City to maintain and monitor these sites for the full five years. This continuation agreement will permit the City to retain the services of URS Corporation Americas to assist in monitoring the mitigation and restoration sites for the remaining maintenance period. The scope of additional services includes collection and testing of soil samples and reporting the City’s additional re-vegetation efforts to the U.S. Army Corps of Engineers in the annual monitoring report.
This continuation agreement will extend the term of the agreement from May 1, 2000 to December 31, 2002, and increase the amount of compensation by $21,000 for a total agreement not to exceed $320,000.
