RECOMMENDATION
Adopt a resolution authorizing the City Attorney to negotiate and
execute:
(a) the first
amendment to the legal services agreement with Foley & Lardner (formerly
Hopkins & Sutter) to increase the compensation by $85,000 to a total amount
not to exceed $135,000; and
(b) the first
amendment to the legal services agreement with Orrick, Herrington &
Sutcliffe to increase the compensation by $50,000 to a total amount not to
exceed $100,000.
Background
On November 27, 2000, the City Attorney executed a legal services
agreement with Hopkins & Sutter for services related to Airport/airline lease and
finance issues.
Hopkins & Sutter subsequently merged with the law firm of Foley
& Lardner. On March 22, 2001, the
City Attorney executed a legal services agreement with Orrick, Herrington &
Sutcliffe for services related to Airport finance issues. The agreements
with both firms expire on June 30, 2001.
Both
of these firms have been providing legal advice with respect to the development
of the Airport Master Plan projects.
Foley & Lardner has been providing legal advice regarding the
proposed financing of the Airport runways as well as other Airport issues,
including the development of the Airport Master plan. Orrick, Herrington & Sutcliffe has been providing legal
advice related to various options that the City may pursue with respect to
financing improvements at the Airport.
Funding
available under these agreement has been exhausted. Final invoices have not been received and will need to be paid
upon receipt. Accordingly, we request
that the City Council authorize amending the agreement with Foley & Lardner
to increase the total compensation to $135,000 and the agreement with Orrick,
Herrington & Sutcliffe to increase the total compensation to $100,000.
