Report on bids and award of contract for the construction of the White Road Median Island Improvements Project (Penitencia Creek Road to Mabury Road) to the low bidder, Indio’s Construction, Inc., to include the base bid and Add Alternate No. 1 in the amount of $385,770, and approval of a contingency in the amount of $19,000.
BACKGROUND
The Median Island Landscape Improvement
Projects are part of the Median Island Landscape program that has been
implemented according to priorities set forth within each Council District.
The White Road Median Island Improvements project is located on White Road between
Penitencia Creek and Mabury Roads. Within the work limits of this project, White Road is both a two-lane thoroughfare (between Reese Way and Mabury Road) and a four-lane thoroughfare (Reese Way and Penitencia Creek Road). The road divides two adjacent Council Districts: Council District 4 to the west, and Council District 5, to the east of White Road. The neighborhood consists of single-family residential development on both sides of White Road. To the west, the road is bordered by backside facing residential development consisting of wood fences, soundwalls, sidewalk and parkstrips with tree and shrub planting. To the east, there are several cul-de-sacs providing access to residential development.
A northern portion of the street median near Penitencia Creek Road consists of a raised curb median with shrub and small tree plantings. The community adjacent to this median maintains the landscaping on the islands. Further south, the median is defined by lane striping within the asphalt-concrete traveled way. In the southern section, by Mabury Road, the median island is paved with concrete.
This project will provide safety and traffic circulation improvements by constructing raised median islands along .5 miles in length of White Road between Penitencia Creek Road and Mabury Road. In addition, the project will provide visual enhancements, consisting of landscaped median islands.
The scope of work consists of the construction of new median islands and includes demolition of asphalt-concrete pavement, concrete curbs, removal of soil, grading and compaction, installation of concrete curbs, topsoil, planting, irrigation and paving materials.
One Add Alternate provides for shrub planting and related work. Construction is scheduled to begin in August with completion in January 2004.

The low bid submitted by Indio Construction, Inc. is 5 percent under the Engineer’s Estimate. The bid documents were evaluated and found to be in order. The bid is considered acceptable for the work involved in the project.
Council Policy provides for a standard contingency of five percent on public works street projects. The standard contingency is appropriate for this project.
Preliminary designs were presented to Council Districts 4 and 5 in November 2002 and January 2003 for display at community meetings. Recommendations to the design were forwarded to each Council District.
To solicit contractors, this project was listed on the City’s Internet Bid Line and advertised in the San José Mercury News, and the San José Post Record. Bid packages for all Department of Public Works construction projects are provided to various builders’ exchanges.
This project and memo have been coordinated with the Departments of Planning, Building and Code Enforcement, Finance, Transportation, the City Manager’s Budget Office, the City Attorney’s Office and Council Districts 4 and 5.

3. SOURCE OF FUNDING: 429 – Building and Structure Construction Tax Fund
4. FISCAL IMPACT: This project is consistent with the Council-approved Budget Strategy Economic Recovery section in that it will spur construction spending in our local economy. The proposed operating and maintenance costs of this project have been reviewed and it has been determined that the project will have no significant adverse impact on the General Fund operating budget.
