SUBJECT:     ADOPTION OF A RESOLUTION TO SUPPORT THE EFFORTS OF THE CALIFORNIA HIGHWAY PATROL (CHP) TO CONDUCT A DRIVING UNDER THE INFLUENCE (DUI) TRAFFIC SAFETY PROJECT USING STATE OFFICE OF TRAFFIC SAFETY (OTS) GRANT FUNDS AND TO AUTHORIZE THE CITY MANAGER TO APPROVE THE RELATED AGREEMENT WITH THE CHP TO ALLOW THE POLICE DEPARTMENT TO PARTICIPATE IN THE TRAFFIC SAFETY PROJECT

 

 

RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

a.       acknowledge that increasing traffic law enforcement is an important element in improving public safety and to support the California Highway Patrol (CHP) in their efforts to conduct a Driving Under the Influence (DUI) traffic safety project with the use of State Office of Traffic Safety (OTS) grant funds, and

 

b.      authorize the City Manager to approve the related OTS grant sub-contractor’s agreement with the CHP to allow the San Jose Police Department to participate in the DUI traffic safety project entitled “Removing Impaired Drivers Project”.

 

 

BACKGROUND

 

The CHP has been awarded a grant from the California State Office of Traffic Safety to be the lead agency for a multi-agency DUI enforcement project.  The San Jose Police Department has been identified as a participating law enforcement agency to conduct a DUI checkpoint in the San Jose area.  The CHP will fund overtime for San Jose officers to staff the checkpoint.  Since the funding source for the overtime will be OTS grant funds, a resolution by City Council is required.  

ANALYSIS

 

The California Highway Patrol has been awarded a grant from the California State Office of Traffic Safety to conduct a multi-agency traffic enforcement program.  The San Jose Police Department has been selected to be a participating agency in a joint DUI checkpoint with the CHP.  The CHP will fund overtime for officers participating in the checkpoint for a total reimbursement not to exceed $7,400.  Since the funding source for the CHP reimbursement is OTS grant funds, the City is required by OTS to approve a resolution in support of the CHP project and to authorize the City Manager to approve the grant sub-contract with the CHP. 

 

 

PUBLIC OUTREACH

 

Not applicable.  The San Jose Police Department has been selected by the CHP to participate in the OTS funded traffic safety project.

 

 

COORDINATION

 

This memorandum has been coordinated with the City Attorney’s Office and the City Manager’s Budget Office.

 

 

COST IMPLICATIONS

 

The California Highway Patrol will provide up to $7,355 in reimbursements to the City for overtime related to sworn staffing for the DUI checkpoint. 

 

This Council item is in line with the General Principles of the Mayor’s Budget Strategy to be open to alternative ways to deliver services through appropriate community partnerships.
