SUBJECT: RATIFICATION OF THE APPLICATION FOR PUBLIC SAFETY OVERTIME REIMBURSEMENT AND THE ACCEPTANCE OF GRANT; AND APPROVAL OF A SIGNATURE RESOLUTION AUTHORIZING CERTAIN STAFF TO EXECUTE ACTION TO OBTAIN FUNDS UNDER THE STATE HOMELAND SECURITY GRANT PROGRAM
REASON FOR ADDENDUM
The City of San Jose was
notified of the opportunity to receive reimbursement for overtime costs
incurred during the Orange Alert period during the recent Iraqi War. Originally
we were told that the City would be a subgrantee only, and no amount of
reimbursement from the State of California was specified. It was anticipated
that Council action would be requested once a specified amount had been
approved by the State of California. The actual notice of award received
indicated that the City will be a direct grantee, and that completion of the
original paperwork constituted a grant application. This information was
received by City staff on Friday, September 5, 2003.
1. That the City of San Jose accepts the award of $252,857 to reimburse the General Fund for portions of the overtime expenses of the Police Department and Fire Department related to the Orange Alert during the Iraqi War of Spring, 2003.
2. That the City of San Jose adopts a resolution designating the Director of Finance, the Deputy Director of Finance, or a Principal Accountant of Finance as the City’s authorized representatives to execute for and on behalf of the City any actions necessary for the purpose of obtaining Federal financial assistance under the State Homeland Security Grant Program.
BACKGROUND

During the Iraqi War of Spring, 2003 the City of San Jose was required by the Federal Aviation Administration to raise the staffing levels for Police personnel at the Mineta San Jose International Airport. In addition, surveillance personnel were added to the downtown area. The
Fire Department had to augment the number of personnel to plan for and respond to activities related to the Orange Alert level. Based on the amount of expense borne by cities nationally, the Congress included some limited funding for reimbursement for specified public safety overtime costs during specified portions of the Iraqi War of Spring, 2003 in the Iraqi War appropriation bill.
The City of San Jose experienced significant excess overtime
expenses related to Federal mandates at the airport, and to the need to enhance
surveillance and other services citywide. It is prudent to benefit from
available funding sources to reimburse the General Fund for these extraordinary
expenses.

The collection of overtime information was coordinated with the Police Department and the Fire Department. The preparation of this report was coordinated with the Finance Department, the Budget Office and the City Attorney.
