PLANNED DEVELOPMENT REZONING ON A 9.17 GROSS
ACRE SITE LOCATED ON THE EAST SIDE OF FLICKINGER AVENUE, APPROXIMATELY 600 FEET
SOUTHERLY OF HOSTETTER ROAD.
The Planning Commission voted 5-0-2 (Campos, Platten absent) to recommend that the City Council approve the Planned Development Rezoning.
BACKGROUND
On August 13, 2003, the Planning Commission held a public hearing to consider a Planned Development from A Agriculture to A(PD) Planned Development to allow up to 84 single-family detached dwelling units.
The Director of Planning, Building and Code Enforcement recommended approval of the proposed .
Juanita Corsino, a manager of the community gardens currently existing on the project site, requested that the project be removed from the Consent Calendar to allow discussion of the project’s impacts upon the community gardens.
Erik Schoennauer spoke on behalf of the applicant, explaining the contractual obligations fo the developer in relation to the community gardens. Mr. Schoennauer indicated that development would not commence work on the project site until the end of December of this year, to allow use of the garden until the end of the growing season. He also indicated that the developer would work closely with the community garden members to plan the transition to a new community garden site on Mabury and assist with the relocation or replacement of structures and orchard trees to the extent feasible.
Four additional members of the community gardens also spoke, emphasizing the quality of the existing gardens and their importance to the community. They indicated that they were happy to hear that the developer would be working closely with them to smoothly relocate the gardens to a new location.
Commissioners Zito, Levy and Dhillon spoke on the project, recognizing the importance of the gardens and asking the developer to begin working immediately with the garden members, rather than waiting until after the City Council hearing on the proposed zoning.
The Planning Commission then closed the public hearing. The Planning Commission then found the project’s environmental review complete and in compliance with CEQA, and recommended approval of the proposed rezoning.
Notices for the Draft Mitigated Negative Declaration and the public hearing were distributed to the owners and tenants of all properties located within 500 feet of the project site and posted on the City web site. Staff has been available to discuss the project with members of the public.
As standard procedure in the development review process, this project was coordinated with the Department of Public Works, Fire Department, Police Department, Environmental Services Department and the City Attorney.
