Fencing Approval Requirements
Requirements
All fencing must comply with the requirements of the San José Municipal Code.

Single-Family Properties
Fences on single-family residential properties are generally limited to three feet in height in the front yard and seven feet in height in the side and rear yards. Corner lots, unusually shaped lots, and Planned Development (PD) zones have different requirements. For more information, please refer to the Fence and Retaining Wall Requirements or contact the Planning Division at 408-535-3555.

Multifamily, Commercial, and Industrial Properties
Fences on multifamily, commercial, and industrial properties must comply with City regulations and are also subject to design review by the Planning Division as part of a Development Permit or Permit Adjustment application. For more information, please contact the Planning Division at 408-535-3555.

Permits
Fences seven feet or less in height generally do not require a building permit. Different requirements apply to retaining walls and swimming pool/spa enclosures. For more information, please refer to the Building Division’s Fence and Retaining Wall Requirements and Swimming Pools and Spas Setback Enclosure Requirements, or contact the Building Division at 408-535-3555.
