Inclusionary Housing Ordinance and the Affordable Housing Impact Fee
Background

The City of San José has demonstrated a commitment to ensuring that affordable housing is available to moderate, low, and very-low income households by adopting an Inclusionary Housing Ordinance (IHO) and a Housing Impact Fee (AHIF) resolution (collectively, the Affordable Housing Programs).

The Affordable Housing Programs require that new housing projects that create three (3) or more new, additional, or modified units may be subject to the requirements of the IHO and AHIF.  The Housing Department has prepared the following documents that outline the process for fulfilling the IHO/AHIF requirements.

Affordable Housing Compliance Plan

The Affordable Housing Compliance Plan application packet 1) provides background and a general understanding of the Affordable Housing Programs, 2) defines what information must be provided for the Housing Department to determine if the project has an affordable housing obligation, and 3) describes the process of Compliance Plan application approval.

The City of San José is in the preliminary stages of completing the various sections of the Guidelines for the Inclusionary Housing Ordinance, Chapter 5.08 of the Municipal Code, and the Affordable Housing Impact Fee, City Resolution No. 77218, including the form Compliance Plan Application for interim and then final adoption.  As such, the City reserves the right to modify or supplement this document as the need arises and further information is developed.
