Ordinances & Regulations

The City of San José’s Cannabis Program is contained within the following ordinances:

  1. The Zoning Ordinance, which regulates where medical and non-medical cannabis collectives and businesses may locate; and 
  2. The Regulatory Ordinance, which regulates how medical and non-medical cannabis collectives and businesses shall operate.

Under the Regulatory Ordinance, the City Manager may promulgate additional regulations as necessary for the Program.




Medical and Non-Medical Cannabis Zoning Ordinance

The Zoning Ordinance can be found in Title 20 of the Municipal Code. The Ordinance, as adopted by the City Council, is online here.

On November 28, 2017, the City Council amended the Zoning Ordinance to include provisions for non-medical cannabis in accordance with state law. The new ordinance is online here


Medical and Non-Medical Cannabis Regulatory Ordinance

The Regulatory Ordinance is Chapter 6.88 of the San José Municipal Code (online here).

On November 28, 2017, the City Council amended the Cannabis Regulatory Ordinance to include provisions for existing Registered Medical Cannabis Collectives to sell non-medical cannabis as of January 1, 2018. The new ordinance is online here.
