Fireworks Rules & Laws
Fireworks are illegalAll fireworks are illegal in San José. Read about the City's laws regarding the use of fireworks.
The fireworks ban applies to all types of fireworks, including:
  • large bottle rockets
  • roman candles
  • firecrackers, 
  • even ‘sparklers’ that are usually reserved for younger children. 

Sparklers can reach over 1,000 degrees Fahrenheit. They account for 50 percent of fireworks-related injuries to children under the age of five and 10 percent of fireworks-related injuries overall.
Nationally, there are twice the number of fires during July's fireworks use and thousands of injuries, particularly for children ages five to 14. Instead of using illegal fireworks, we encourage you to take family and friends to one of the local, professional fireworks shows. 

About the Fireworks Ordinance
San José Municipal Code 10.17.100  - 
Except where otherwise expressly provided in this Code, it is unlawful for any person to possess, store, offer for sale, expose for sale, sell at retail, or use or explode any fireworks (including Sparklers and Safe and Sane Fireworks). Read the full ordinance.

Stiffer Penalties for Illegal Fireworks Use
In April 2016, the City Council approved higher fines for the sale, use, possession, or storage of fireworks. The fines for fireworks-related violations are $500 for a first violation, $700 for a second violation, and $1,000 for a third violation. The City increases its enforcement efforts during the 4th of July holiday.
