Medical Marijuana
On June 17, 2014, the San José City Council approved a medical marijuana program (Program) regulating where medical marijuana establishments could operate in the City, who could operate them and how they could operate.

There are two components to the program, each codified in the following Council-approved ordinances:
  • the Medical Marijuana Land Use Ordinance; and 
  • the Medical Marijuana Regulatory Ordinance.

These ordinances, together with the City Manager Regulations for Medical Marijuana, set forth the rules for operating in San Jose.

For example, the Program requires all medical marijuana establishments, including collectives, cooperatives and dispensaries (“Collectives”) to register with the City. 

Registration with the City required each Collective to, by October 17, 2014, submit
  1. An Application for a Zoning Code Verification Certificate (Zoning Application) to show its location complies with the Medical Marijuana Land Use Ordinance; and, 
  2. An Application for Registration as a Medical Marijuana Collective (Registration Application) to show it will operate in strict compliance with the Medical Marijuana Regulatory Ordinance.

Please note: The City is not taking new applications at this time.
 

If a Collective's location met all siting requirements in the Medical Marijuana Land Use Ordinance, it received a Zoning Code Verification Certificate. If a Collective then met all requirements for Registration in the Medical Marijuana Regulatory Ordinance, the Collective received a Notice of Completed Registration. 


Collectives were required to obtain a Zoning Code Verification Certificate by July 17, 2015 and a Notice of Completed Registration by 5 p.m. on December 18, 2015.

By the December 18, 2015 deadline, sixteen Collectives had received a Notice of Completed Registration from the City.

The San José Municipal Code prohibits medical marijuana businesses from operating without a Notice of Completed Registration as a Medical Marijuana Collective.
