Notice to
the Public
The procedure for this hearing is
as follows:
- Hearing Officer will identify the
project as described on the agenda.
- Staff Report.
- After the staff report, the
applicant and/or representative should make themselves known as their item comes up by
approaching the microphone and identifying themselves and stating their home address, or
just wave from the audience if you do not wish to speak..
- Public testimony, either for or
against the project. Please state your name and home address for the record.
- The Hearing Officer may ask
questions of the speaker.
- After the public testimony, the
applicant may make closing remarks.
- The public hearing will then be
closed and the Planning Director will take action on the item. The Planning Director
may request staff to respond to the public testimony, ask staff questions, and discuss the
item.
If you challenge these land
use decisions in court, you may be limited to raising only those issues you or someone
else raised at this public hearing or in written correspondence delivered to the City at,
or prior to, the public hearing.
The Planning Director's action
on these agenda items is final when the permit is signed and mailed, unless the permit is
appealed. The Planning Director's actions are appealable in
accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business
1. Deferrals
Any item scheduled for hearing this
evening for which deferral is being requested will be taken out of order to be heard first
on the matter of deferral. A list of Staff-recommended deferrals is available on the Press
Table. If you want to change any of the deferral dates recommended, or speak to the
question of deferring these or any other items, you should say so at this time. I will now
open the public hearing. The following items are proposed to be deferred.

- TR03-117. Tree Removal Permit
to remove one Ash Tree 70 inches in circumference on a 0.14 gross acre site in the R-1-8
Single-Family Residence Zoning District, located at/on the south side of Albion Drive
approximately 170 feet easterly of Narvaez Avenue. (692 ALBION DR) (Chitwood Irene G
Trustee, Owner). Council District 10. SNI: None. CEQA: Exempt. Deferred from 1/14/04.
Recommend:
Deferred to 1/21/04.
- TR03-074. Tree Removal Permit
to remove 32 trees of varying species including, but not limited to, Eucalyptus, Redwood
and Monterey Pine trees ranging in size from 56 to 168 inches in circumference on a 25.0
gross acre site in the R-M(CL) Residence Zoning District, located at/on the southwest
corner of Almaden Expressway and Crown Boulevard (6559 COPPERWOOD CL) (Copperwood
Homeowners Association, Owner). Council District 10. SNI: None. CEQA: Exempt. Deferred
from 12/17/03 and 1/14/04.
Recommend: Approval.
- H03-053. Site Development Permit
to allow an approximately 1,345-square-foot addition to an existing commercial building
and related minor site plan changes at a shopping center (Westgate West) on an 18.6-acre
site in the CG General Commercial Zoning District, located on the northeast corner of
Prospect Road and Lawrence Expressway (5285 Prospect Road). Cupertino Partners VI et al.,
owner; Kenneth Rodrigues Partners, applicant. Council District: 1. SNI: None. CEQA:
Exempt. Deferred from 1/14/04.
Recommend: Deferred to 1/28/04.
- TR03-147. Tree Removal Permit
to legalize the previous removal of a Douglas Fir tree 75 inches in circumference on a
0.16-acre site in the R-1-8 Single-Family Residence Zoning District, located at 4704 McCoy
Avenue (Roger and Jean Ramey, owners/applicants). Council District: 1. SNI: None. CEQA:
Exempt.
Recommend: Approval.
- TR03-149. Tree Removal Permit to
allow removal of one Deodar Cedar tree 84 inches in circumference on a 0.17-acre site in
the R-1-8 Single-Family Residence Zoning District, located at 6661 Prospect Road (Venu and
Smitha Varma, owners/applicants). Council District: 1. SNI: None. CEQA: Exempt.
Recommend:
Approval.
- TR03-141. Tree Removal Permit
to allow removal of one Maple tree 81 inches in circumference on a 0.13-acre site in the
R-1-8 Single-Family Residence Zoning District, located at 5043 Rio Vista Avenue (Srinivas
and Pushpalatha Vempati, owners/applicants). Council District: 1. SNI: None. CEQA: Exempt.
Recommend: Approval.
- PD03-055. Planned Development
Permit to allow 114 single-family attached residential units on a 4-acre site in the
A(PD) Planned Development zoning district, located on the north side of Hillsdale Avenue
opposite the terminus of Vista Park Drive (Tuscany Hills Blocks 8 and 9). KB Home South
Bay, owner/developer. Council District: 7. SNI: None. CEQA: Use of a Master EIR.
Recommend:
Approval.
