Notice to
the Public
The procedure for this hearing is
as follows:
- Hearing Officer will identify the
project as described on the agenda.
- Staff Report.
- After the staff report, the
applicant and/or representative should make themselves known as their item comes up by
approaching the microphone and identifying themselves and stating their home address, or
just wave from the audience if you do not wish to speak..
- Public testimony, either for or
against the project. Please state your name and home address for the record.
- The Hearing Officer may ask
questions of the speaker.
- After the public testimony, the
applicant may make closing remarks.
- The public hearing will then be
closed and the Planning Director will take action on the item. The Planning Director
may request staff to respond to the public testimony, ask staff questions, and discuss the
item.
If you challenge these land
use decisions in court, you may be limited to raising only those issues you or someone
else raised at this public hearing or in written correspondence delivered to the City at,
or prior to, the public hearing.
The Planning Director's action
on these agenda items is final when the permit is signed and mailed, unless the permit is
appealed. The Planning Director's actions are appealable in
accordance with the requirements of Title 20 0f the Municipal Zoning Code.

1. Deferrals
Any item scheduled for hearing this
evening for which deferral is being requested will be taken out of order to be heard first
on the matter of deferral. A list of Staff-recommended deferrals is available on the Press
Table. If you want to change any of the deferral dates recommended, or speak to the
question of deferring these or any other items, you should say so at this time. I will now

to construct 26 single-family attached
residences on a 0.67 gross acre site.
Recommend: Approval.
2. PT03-099. Planned Tentative Map Permit to
consolidate 5 parcels into 1 lot for single-family attached residential uses on 0.67
gross acre.
Recommend: Approval.
- TR03-103. Tree Removal Permit
to remove one Pepper tree/91 inches in circumference on a 0.19 gross acre site. in the
R-1-8 Single-Family Residence Zoning District, located at/on the 153 South 14th Street
(153 S 14TH ST) (Enderwick Thomas J And Cynthia Y, Owner). Council District 3. SNI:
University. CEQA: Exempt.
Recommend: Approval.

- TR03-117. Tree Removal Permit
to remove one Ash Tree 70 inches in circumference on a 0.14 gross acre site in the R-1-8
Single-Family Residence Zoning District, located at/on the south side of Albion Drive
approximately 170 feet easterly of Narvaez Avenue. (692 ALBION DR) (Chitwood Irene G

Recommend: Denied.
- TR03-096. Tree Removal Permit
to remove three trees 63 to 67 inches in circumference on a 3.7 gross acre site in the
R-1-8(PD) Planned Development Zoning District, located at/on the northwest corner of
McLaughlin Avenue and Yerba Buena Road (3975 MCLAUGHLIN AV) (Church Of Christ L D S Corp

Approval.
- HA00-049-01. Site Development
Permit Amendment to construct a 398 square-foot addition to a previously approved
medical office buildng on a 0.14 gross acre site in the CO Office Commercial Zoning
District, located at/on the southerly of Clarmar Way and northerly of Revey Avenue (2050
CLARMAR WY) (Anthony Caruso, Owner). Council District 6. SNI: Burbank/Del Monte. CEQA:
Exempt.

- SF03-032. Single Family House
Permit to construct one 2,714 square-foot 2-story single family detached residence on
a 0.13 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on
the east side of Plaza Drive approximately 400 feet northerly of Coe Avenue (APN:

- PT03-113. Tentative Map Permit
(Condominium) to subdivide one parcel into 138 lots for residential and open space uses on
a 7.0 gross acre site in the A(PD) Planned Development Zoning District, located on the
south side of Curtner Avenue approximately 750 feet easterly of Highway 87 (MTA Properties

- H03-053. Site Development Permit
to allow an approximately 1,345-square-foot addition to an existing commercial building

site in the CG General Commercial Zoning District, located on the northeast corner of

- V03-013. Sign Variance to allow
addition of two attached signs to an existing commercial building (Office Depot) on a
4.7-acre site in the CG General Commercial Zoning District, located at the southwest
corner of Stevens Creek Boulevard and Lopina Drive (4360 Stevens Creek Boulevard Unit A).

- H03-056. Site Development Permit
for the demolition of an existing public library and construction of a new 20,000 square
foot public library on a 2.5 gross acre site in the A-Agricultural Zoning District,
located at/on the north side of Aborn Road, approximately 100 feet easterly of Renfield
Way (2635 Aborn Road) (City of San Jose, Owner/Developer). Council District 8. SNI: None.

- PDA01-029-01. Planned
Development Permit Amendment to modify the previously approved conditions of a 62
single family attached residential project for construction hours on Saturdays and Sundays
from 8:00am to 5:00pm on a 0.96 gross acre site in the A(PD) Planned Development Zoning
District, located at/on the east side of North Second Street at the eastern terminus of
Bassett Street (9489 TRACT) (San Jose Lofts, Llc, Owner). Council District 3. SNI: 13th
Street. CEQA: Reuse of previously approved Negative Declaration.
