The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral.     Recommend: Approval.

  2. TR04-006. Tree Removal Permit to allow removal of one Pine Tree approximately 100 inches in circumference on a .17-acre site in the R-1-8 Single-Family Residence Zoning District, located at 1104 Marilla Avenue (Cerin Family Trust, owner/applicant). Council District: 1. SNI: None. CEQA: Exempt.

    Recommend: Approval.

  3. TR03-143. Tree Removal Permit to allow removal of one Mulberry tree 81 inches in circumference and one Ash tree 57 inches in circumference on a 0.13-acre site in the R-1-8 Single-Family Residence Zoning District, located at 5152 Tisdale Way (Herman and Janice Stavang, owners/applicants).   4. H03-053. Site Development Permit to allow an approximately 1,345-square-foot addition to an existing commercial building and related minor site plan changes at a shopping center (Westgate West) on an 18.6-acre site in the CG General Commercial Zoning District, located on the northeast corner of Prospect Road and Lawrence Expressway (5285 Prospect Road).   5. PD03-074. Planned Development Permit to allow 14 single-family attached residential units on a 0.7-acre site (Tuscany Hills block 13) in the A(PD) Planned Development Zoning District, located on the north side of Hillsdale Avenue, opposite the terminus of Vistapark Drive (KB Home South Bay, owner/developer). Council District: 7. SNI: None. CEQA: Use of a Master EIR.

    Recommend: Approval.

  6. PD04-004. Planned Development Permit to allow an existing health club to operate between the hours of 5:00 a.m. and midnight at Santana Row on a 1.78 gross acre site in the A(PD) Planned Development Zoning District, located on the northeast corner of Olin Avenue and South Winchester Boulevard (3055 OLIN AV) (FRIT San Jose Town & Country Vil LLC, Owner; Club One, Inc.   7. TR03-109. Tree Removal Permit to remove one Sugar Pine Tree approximately 132 inches in circumference on a 0.14 gross acre site in the R-1-8 Single-Family Residence Zoning District, located on the easterly side of Sorrel Avenue approx. 50 feet northerly of Arabian Street.   9. H03-057. Site Development Permit to construct a 20,000 square foot public library on a portion of a public school property on a 2.5 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at the Eastside of Hopkins Drive, approximately 150 feet southeasterly of Simon Avenue (1720 HOPKINS DR) (Alum Rock Union S D/Owner; City of San Jose/Developer).   2. SF03-032. Single Family House Permit to construct one 2,714 square-foot 2-story single family detached residence on a 0.13 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the east side of Plaza Drive approximately 400 feet northerly of Coe Avenue (APN: 264-52-097) (Charles R.De Rose, Owner/Developer).   3. V03-012. Sign Variance from the size and setback requirements established in Title 23 of the San Jose Municipal Code to allow installation of a 30 square foot detached/monument sign with a 5 foot setback from the side property line, on a 1.61 gross acre site in the CN Neighborhood Commercial Zoning District, located on the northeast corner of Alum Rock Avenue and Ribbs Lane (2345 Alum Rock Avenue) (Central Calif.   4. RA03-002. Reasonable Accommodation Permit to allow a residential service facility (Sober Living Environment) for up to twelve (12) residents including eleven (11) adult residents and one (1) staff member in a single-family residence located at 704 Kirk Glen Drive.   5. SP04-003. Special Use Permit to construct a new single family residence with an alternative parking design (tandem garage) on a 0.11 gross acre site in the R-2 Two-Family Residence Zoning District, located on the north side of Schiele Avenue approximately 490 feet south of Stockton Avenue (Cimolino David L And Alana M, Owner).   6. H03-066. Site Development Permit to construct 4 single-family attached residences for a total of 6,592 square feet on a 0.179 gross acre site in the R-M Multiple Residence Zoning District, located on the east side of South 21st Street, approximately 300 feet southerly of East Santa Clara Street (18 South 21ST ST) (Greg Henderson, Owner).   9. PDA02-061-01.
