Notice to
the Public
The procedure for this hearing is
as follows:
- Hearing Officer will identify the
project as described on the agenda.
- Staff Report.
- After the staff report, the
applicant and/or representative should make themselves known as their item comes up by
approaching the microphone and identifying themselves and stating their home address, or
just wave from the audience if you do not wish to speak..
- Public testimony, either for or
against the project. Please state your name and home address for the record.
- The Hearing Officer may ask
questions of the speaker.
- After the public testimony, the
applicant may make closing remarks.
- The public hearing will then be
closed and the Planning Director will take action on the item. The Planning Director
may request staff to respond to the public testimony, ask staff questions, and discuss the
item.
If you challenge these land
use decisions in court, you may be limited to raising only those issues you or someone
else raised at this public hearing or in written correspondence delivered to the City at,
or prior to, the public hearing.
The Planning Director's action
on these agenda items is final when the permit is signed and mailed, unless the permit is
appealed. The Planning Director's actions are appealable in
accordance with the requirements of Title 20 0f the Municipal Zoning Code.

1. Deferrals
Any item scheduled for hearing this
evening for which deferral is being requested will be taken out of order to be heard first
on the matter of deferral. A list of Staff-recommended deferrals is available on the Press
Table. If you want to change any of the deferral dates recommended, or speak to the
question of deferring these or any other items, you should say so at this time. I will now

2. Consent
- TR04-012. Tree Removal Permit
to remove one Monterey Pine tree 75 inches in circumference on a 0.13 gross acre site in
the R-2 Two-Family Residence Zoning District, located at 1168 Hanchett Avenue (Turco
Michael T And Turko Jennifer B, Owner). Council District 6. SNI: None. CEQA: Exempt, File
No. TR04-012.
Recommend: Approval.
- SP04-008. Special Use Permit
to allow an alternative parking design (tandem garage) and construction of an accessory
building in excess of 650 square feet. The project proposes to demolish two existing
structures including a garage and storage building, construct a detached garage with
breezeway for a total of 744 square feet, and to provide two covered parking spaces in a
tandem configuration for an existing single-family detached residence on a 0.15 gross acre
site in the R-1-8 Single-Family Residence Zoning District, located on the north side of
Emory Street approximately 350 feet easterly of Bascom Avenue (1901 Emory ST) (Hendershott
Robert J & Fama Rosemary Trust, Owner). Council District 6. SNI: None. CEQA: Exempt.

Approval.
- SP04-013. Special Use Permit
to allow the temporary outdoor use of private property for a carnival in the parking lot
of an existing shopping center for up to 10 days on a 12.98 gross acre site in the CP
Pedestrian Commercial Zoning District, located on the Southside of Story Road
approximately 140 feet westerly of Bal Harbor Way (1824 STORY RD) (City Of San Jose
Redevelopment Agency, Owner). Council District 5. SNI: East Valley/680 Communities. CEQA:
Exempt, File No. SP04-013.
Recommend: Approval.
- TR04-015. Tree Removal Permit to
remove one Cedar tree 92 inches in circumference and one Redwood tree 80 inches in
circumference on a 0.13 gross acre site in the R-1-8 Single-Family Residence Zoning
District, located at/on the 1011 Patricia Way (1011 PATRICIA WY) (Schatz Hans O And
Charlotte A Trustee, Owner). Council District 6. SNI: None. CEQA: Exempt.
Recommend:
Approval.
- HA82-249-01. Site Development
Permit Amendment to allow for the removal and replacement of 4 Eucalyptus trees, 58 to
71 inches in circumference and 31 non-ordinance-size trees on a 8.75 gross acre site in
the IP Industrial Park Zoning District, located on the southeast corner of Montague
Expressway and O'Toole Avenue (1060 RINCON CL) (Carramerica Realty Corp, Owner). Council
District 4. SNI: None. CEQA: Exempt.
Recommend: Approval.

- HA76-044-01. Site Development
Permit Amendment to install wrought iron fencing along a property line within a
surface parking area at an existing retail center on a 2.3 gross acre site in the CO
Office Commercial and CG Commercial General Zoning Districts, located on the northeasterly
corner of The Alameda and West Julian Street (1065 THE ALAMEDA) (Berns Bertram M Trustee,
Owner). Council District 6. SNI: None. CEQA: Exempt. Deferred from 3/17/04.

- PDA01-101-01. Planned
Development Permit Amendment for modifications to site landscaping including: 1)
after-the-fact approval of two previously removed dead Coastal Live Oak trees, 63 inches
and 88 inches in circumference, and; 2) installation of new 36 box trees on a 44
gross acre site (Santana Row) in the A(PD) Planned Development Zoning District, located on
the southeast corner of Stevens Creek Boulevard and South Winchester Boulevard (3055 OLIN
AV) (Frit San Jose Town & Country Vil Llc, Owner). Council District 6. SNI: None.
CEQA: Exempt.
Recommend: Approval.
- The projects being considered are located at/on westerly side of Meridian Avenue between
Hillsdale Avenue and Foxworthy and Willow Creek Drive, in the A(PD) Planned Development
Zoning District (Hacienda Gardens, LLC, Owner/Developer). Council District 9. SNI: None.
CEQA: Mitigated Negative Declaration.
1. PD03-038. Planned Development Permit to allow 299 multi-family attached residences,
approximately 168,184 square feet of commercial uses, and to allow an existing nightclub
(Cardinal) and 24-hour uses (Cardinal, Rite-Aid and Albertson's) on a 20.86 gross acre
site.

2. PT03-068. Planned Tentative Map Permit to subdivide/reconfigure 9 parcels into 299
lots for residential and commercial uses on a 20.86 gross acre site.

- PDA97-021-02. Planned
Development Permit Amendment to construct a 1,000 square foot cabana (accessory
structure) behind an existing single-family detached residence on a 0.55 gross acre site
in the A(PD) Planned Development Zoning District, located at/on the northwest corner of
Beaumont Canyon Drive and Foxtail Court (5360 Beaumont Canyon Dr) (Schoene Lloyd R And
Marites I, Owner). Council District 8. SNI: None. CEQA: Exempt. Continued from 2/25/04,
3/10/04, and 3/17/04.
Recommend: Approval.
