The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral.   2. PD04-001. Planned Development Permit to construct 148 affordable multi-family attached residences and 5,350 square feet for retail/office uses on a 1.99 gross acre site in the A(PD) Planned Development Zoning District, located at the northeast corner of South 5th and Keyes Streets (Carolyn Gleeson Et Al, Owner; Martha Putnam, Developer). Council District 3. SNI: Spartan/Keyes. CEQA: Mitigated Negative Declaration (File No. PDC03-029).

    Recommend: Approval.

  3. SP04-015. Special Use Permit to allow restoration of a legal nonconforming detached garage and accessory building totalling approximately 1,436 square feet on a 0.19 gross acre site in the LI Light Industrial Zoning District, located at/on the eastside of South Second Street approximately 290 feet southeasterly of Martha Street (944 S. Second Street) (John C. Bondi, Owner). Council District 3. SNI: Spartan/Keyes. CEQA: Exempt.

    Recommend: Approval.

  4. SP04-014. Special Use Permit to allow a temporary parking lot for construction vehicles servicing the adjacent Santa Clara Valley Water District property currently under reconstruction on a 5.86 gross acre site in the R-1-8 Single-Family Residence Zoning District, located on the south side of Suncrest Avenue approximately 760 feet easterly of Vista Del Mar (San Jose Water Company, Owner). Council District 4. SNI: None. CEQA: Exempt.

    Recommend: Approval.

  5. SP02-059. Special Use Permit for a 3-car detached garage (676 square feet) for an existing legal non-conforming single-family residence on a 0.22 gross acre site in the A Agricultural Zoning District, located at/on the northside of Sierra Road approximately 530 feet westerly of Varner Court (3425 SIERRA RD) (Luu Trang, Owner). Council District 4. SNI: None. CEQA: Incomplete.

    Recommend: Denial.

  6. The projects being considered are located on the north side of Michigan Avenue approximately 150 feet westerly of Pacific Avenue, in the R-1-8 Single-Family Residence Zoning District (SANTOS JENIFER M, Owner; Bruce Johnson, Architect). Council District 4. SNI: None. CEQA: Exempt.

    1. V04-001. Development Variance Permit to permit the construction of a single-family reisdence above the height limitations of the R-1-8 Zoning District from 2½ stories to 3-stories within the Alviso Planning Area a 0.13 gross acre site.

    Recommend: Approval.

    2. SF03-033. Single Family House Permit to construct a new 2,892 square foot single-family detatched residence and 1,740 squre foot garage on a 0.13 gross acre site.

    Recommend: Approval.

  7. SP02-053. Special Use Permit to legalize a 456 square-foot structure (aviary) at an existing single-family residence on a 0.37 gross acre site in the R-1-8 Single-Family Residence Zoning District, located on the south side of El Grande Drive approximately 300 feet easterly of Vista Del Mar (3687 EL GRANDE DR) (Freitas Tony P And Louise M, Owner). Council District 4. SNI: None. CEQA: Exempt.

    Recommend: Denial.

  8. PDA03-004-03. Planned Development Permit Amendment to finalize architectural and landscaping details for 70 previously approved single-family attached residential units on a 60.2-acre site in the A(PD) Planned Development Zoning District, located on the south side of Curtner Avenue approximately 900 feet easterly of Highway 87 (MTA Properties LP, owner; Summerhill Homes, developer). Council District: 7. SNI: None. CEQA: Negative Declaration.

    Recommend: Approval.

  9. HA76-044-01. Site Development Permit Amendment to install wrought iron fencing along a property line within a surface parking area at an existing retail center on a 2.3 gross acre site in the CO Office Commercial and CG Commercial General Zoning Districts, located on the northeasterly corner of The Alameda and West Julian Street (1065 THE ALAMEDA) (Berns Bertram M Trustee, Owner).
