If you challenge these land use decisions in court, you may be limited to raising only those issues you or someone else raised at this public hearing or in written correspondence delivered to the City at, or prior to, the public hearing.

The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business

 

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The following items are proposed to be deferred.

  1. V04-003. Development Exception Permit to allow 10% reduction in the required parking due to proximity to LRT station for an existing shopping center on a 6.91 gross acre site in the CP Pedestrian Commercial Zoning District, located on the southeasterly corner of Blossom Hill Road and Snell Avenue (432 BLOSSOM HILL RD) (Downer Square Investment Company, Owner). Council District 2. SNI: None. CEQA: Exempt.

    Recommend: Defer to 6/30/04.

2. Consent

  1. PDA79-016-03. Planned Development Permit Amendment for tree removal of six Blue Oak 64-102 inches, one Coast Live Oak 135 inches, one Valley Oak 60 inches, Two Coast Redwood 72 - 109 inches in circumference on an 53 gross acre site in the A(PD) Planned Development Zoning District, located at/on the southeast corner of Meridian Avenue and Coleman Road (5928 KYBURZ PL) (Renken Wayne G Trustee & Et Al, Owner).   2. PD04-026. Planned Development Permit to allow finalization of architectural and site design details for two previously approved single-family detached residences and two previously approved duplexes on a 0.4-acre site in the A(PD) Planned Development Zoning District. The project site is located on the east side of Cypress Avenue approximately 70 feet northerly of Adra Avenue (432 South Cypress Avenue). E & H Partnership, owner; Emily Chen, developer. Council District: 1. S.N.I.: None. CEQA: Negative Declaration. Deferred from 6/16/04.

  3. TR04-031. Tree Removal Permit to remove one Cedar tree, 78 inches in circumference on a 0.15 -acre site in the R-1-8 Single-Family Residence Zoning District, located at 3114 San Luis Rey Avenue (Kushner Ian S And Claire, Owner). Council District 9. SNI: None. CEQA: Exempt.

3. Public Hearings

  1. PD04-017. Planned Development Permit to allow an entertainment, including dancing, drinking and public eating establishment with hours of operation from midnight until 2:00am daily on the 1st floor of an existing 3,883 square feet building and a Liquor License Exeption on a 1.067 net acre site in the A(PD) Planned Development Zoning District, located on the northwest corner South 3rd and East San Fernando Streets (99 East San Fernando Street) (Century Residential LLC James Fox, Owner). Council District 3. SNI: None. CEQA: Exempt. Deferred from 6/16/04.

    Recommend:

  2. PD03-064 and PT03-098. A Planned Development Permit to construct 26 single-family detached residences located in the A(PD) Planned Development Zoning District and a Tentative Map Permit to subdivide four parcels into 26 lots, on a 7.02 gross acre site located at the southwest corner of Almaden Road and Barnes Lane (19291 Almaden Road) (Kamali Ehteram, Owner).   3. PDA87-056-01. Planned Development Permit Amendment to allow a 75kW gas fired cogeneration machine at a senior care facility on a 4.0 gross acre site in the A(PD) Planned Development Zoning District, located at/on the west side of Alvin Avenue approximately 330 feet northwesterly of Flanigan Drive (2501 Alvin Avenue) (Nguyen Ngai X, Owner).
