The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business

 

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The following items are proposed to be deferred.

1. TR02-132. Tree Removal Permit to remove 1 Liquid Amber tree 74 inches in circumference on a 0.18 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at 2851 Lansford Avenue. (CASAD STEVEN J AND GOVE PHYLLIS A TRUSTEE, Owner). Council District 9. CEQA: Exempt.

Recommend: Approval.

3. Public Hearing

1. H02-044 Site Development Permit for a project located at the southerly side of Phelan Avenue, approximately 250 feet easterly of Monterey Road on a 0.72-gross-acre site in the HI-Heavy Industrial Zoning District for expansion of an existing parking/storage area and associated site improvements. (Noe Longoria Owner; Noe Longoria, Developer) Council District 7. CEQA: Exempt.

Recommend: Approval.

2. HP02-019. HISTORIC PRESERVATION PERMIT for a project located on the west side of North Fifth Street, approximately 450 feet southerly of East Empire Street, (451 N. 5th Street), on an 0.12-gross-acre site, in the LI Light Industrial Zoning District to renovate a single family residence, reconstruct a 400 square-foot addition and construct a 650 square foot detached garage in the HensleyHistoric District, (HD86-37), (Saeid Pourabdollah, Owner/Developer). Council District 3. CEQA: Exempt. Deferred from 12/18/02.

Recommend: Approval.

3. The projects being considered are located on the east side of North White Road, approximately 670 feet southerly of McKee Road, on a 0.66-gross-acre site, in the A(PD) Planned Development Zoning District (Mike Miroyan, Owner/Developer). Council District 5. CEQA: Negative Declaration.

a. PD02-023. PLANNED DEVELOPMENT PERMIT to construct 12 single-family attached residential units.Deferred from 1/8/03.

Recommend: Approval.

b. PT02-049. TENTATIVE MAP to subdivide one (1) parcel into 13 lots for residential use. Deferred from 1/8/03.

Recommend: Approval.

4. HP02-023. HISTORIC PRESERVATION PERMIT for a project located at the north side of Taylor Street approximately 50 feet west of Gold Street in the Alviso Planned Community on a 0.303-gross-acre site in the CN Commercial Neighborhood Zoning District for exterior alterations to The Alviso Town Hall (City Landmark #HL00-117). (City of San Jose, Owner, Department of Public Works, Architectural Engineering Division, Developer). Council District 4. CEQA: Exempt. Deferred from 1/15/03.

Recommend: Approval.

5. The projects being considered are located at the northeast corner of N. Fourth and E. Julian Streets in the CO Commercial Office Zoning District on a 0.07 gross acre site (Thang Vu, Owner/Developer). Council District 3. CEQA: Exempt.

a. HP01-06-010. Historic Preservation Permit for the design of a new commercial structure in the Hensley Historic District. Deferred from 11/20/02 and 12/18/02.

Recommend: Approval.

b. H01-06-048. Site Development Permit for demolition of an existing residential structure and construction of a 2,320 square foot office building. Deferred from 11/20/02 and 12/18/02.

Recommend: Approval.

c. V02-013. Development Variance to reduce the required front, corner, and interior side setbacks of 15, 12.5 and 5 feet respectively to 11.75, 6.8 and 2.6 respectively to allow construction of a proposed office building. Deferred from 11/20/02 and 12/18/02.

Recommend: Approval.

6. PDA91-58-006 Planned Development Permit for a project located on the east side of Glenview Drive opposite Eagle Crest Court (Lot 73) on a 1.3 gross-acre site in the A(PD) Planned Development Zoning District for the construction of one single family detached residence (A. Betpolice, Owner/Developer) Council District 10. CEQA: Mitigated Negative Declaration.

Recommend: Approval.

7. H01-071. Site Development Permit to construct three industrial buildings totaling 275,000 square feet on a 17.98 gross acre site in the IP Industrial Park Zoning District, located at/on the west side of Old Oakland Road approximately 400 feet southerly of Brokaw Road (1633 Oakland Road) (MARVIN FOX, Owner/Developer). Council District 4. CEQA: Negative Declaration.

Recommend: Approval.

8. H02-055. Site Development Permit for a project located at the northeast corner of Highway 280 and Lincoln Avenue on a 2.58-gross-acre site in the IP Industrial Park Zoning District for the installation of two ATMS, new patio and walkway to an existing office building (Valley Credit Union, Owner/Developer) Council District 06. CEQA: Exempt.

Recommend: Approval.

9. PD02-034. Planned Development Permit to allow demolition and construct 53,640-square-foot addition to existing hotel/restaurant on a 5.0 gross acre site in the CO(PD) Planned Development Zoning District, located at/on the southwest corner of North 1st Street and Highway 101 (1751 N 1ST ST) (Hanford Hotels, LLC Peter A Trapolino, Owner/Developer). Council District 3. CEQA: Exempt. Deferred from 12/11/02, 1/8/03 and 1/15/03.

Recommend: Approval.
