The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business

 

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The following items are proposed to be deferred.

2. Consent

1. TR02-128. Tree Removal Permit to remove 1 Deodora Cedar tree/84"C and 1 Monterey Pine tree/84"C on a 0.16 gross acre site in the R-M Multiple Residence Zoning District, located at/on the 78 South 10th Street (78 S 10TH ST). (MISOFF VIRGINIA E, Owner). Council District 3. CEQA: Exempt.

Recommend: Approval.

2. TR02-086 TREE REMOVAL PERMIT for a project located at 1134 Cabot Place, on a 0.14-gross-acre site in the R-1-8 Residence Zoning District, for the removal of two Shamel Ash trees approximately 120 and 129 inches in circumference (Gerold and Virginia Kaminski, Owners). Council District: 1. CEQA: Exempt.

Recommend: Approval.

3. PD02-067. PLANNED DEVELOPMENT PERMIT to allow a surface parking lot (approximately 125 parking stalls) for automobile dealership uses on a 1.0-gross-acre site in the A(PD) Planned Development Zoning District, located at/on the southeast corner of Foxworthy Avenue and Rubino Drive (Rubino Trust, Owner; Bob Lewis, Developer). Council District: 6. CEQA: Use of a Master EIR.

Recommend: Approval.

4. TR02-136. Tree Removal Permit for a project located at 1994 Heatherdale Avenue, on a 0.20-gross-acre site, in the R-1-8 Single-Family Residence Zoning District to remove onbe (1) Juniper tree 76 inches in circumference (Mia Alonso, Owner/Developer). Council District 6. CEQA: Exempt.

Recommend: Approval.

5. TR03-001. TREE REMOVAL PERMIT for a project located at 1253 Fremont Street, on a 0.30-gross-acre site, in the R-1-8 Zoning District for the removal of one (1) Douglas Fir tree approximately 92 inches in circumference (Robert & April Bignell, Owner/Developer). Council District 6. CEQA: Exempt.

Recommend: Approval.

The consent calendar is now closed.

3. Public Hearing

1. HP02-017. HISTORIC PRESERVATION PERMIT for a project located at the southwest corner of Cahill and West Santa Clara Streets on a 12.2-gross-acre site in the LI Light Industrial Zoning District to allow modifications to the San Jose Diridon Caltrain Station (City Landmark #HL94-100) to comply with the Americans with Disabilities Act, including the installation of a wheelchair platform lift and modifications to an existing ramp, floor, and platform facilities. (Peninsula Corridor Joint Powers Board, Owner/Developer). Council District 6. CEQA: Exempt.

Recommend: Approval.

2. PD03-005. Planned Development Permit for a project located at the northerly side of Story Road, at the northerly terminus of Roberts Avenue on a 7.57-gross-acre site in the A (PD) Planned Development Zoning District for allowing the temporary sales of used cars on an existing commercial site. (Super Kmart Owner; Buy and Drive Automotive Marketing, Developer) Council District 7. CEQA: Exempt.

Recommend: Approval.

3. SP02-076. Special Use Permit for a project located at the easterly side of Lyric Lane, approximately 150 feet northerly of River View Drive on a 0.22-gross-acre site in the R-1-8 Residence Zoning District for the construction of an approximately 3-foot high, retaining wall along a side property line of an existing single-family detached residence. (Michael Semsak Owner; Michael Semsak, Developer) Council District 2. CEQA: Exempt.

Recommend: Approval.

4. H02-058. Site Development Permit for a project located at the westerly side of US 101, between Azucar Avenue and Blossom Hill Road on a 25.11-gross-acre site in the R-MH Mobilehome Park Zoning District for the addition of (2) two spaces to an existing mobilehome park. (Casa Alondra Mobile Home Park, LLC Owner; Casa Alondra Mobile Home Park, LLC, Developer) Council District 2. CEQA: Exempt.

Recommend: Approval.

5. The projects being considered are located at/on east side of North White Road approximately 670 feet southerly of McKee Road (246 N WHITE RD) on 0.66 groos acre site, in the A(PD) Planned Development Zoning District (TS CIVIL ENGINEERING Mr MIKE MIROYAN, Owner). Council District 5. CEQA: Negative Declaration.

a. PD02-023. Planned Development Permit to construct 12 single-family attached residences.

Recommend: Approval.

b. PT02-049. Tentative Map Permit to reconfigure 1 parcels into 13 lots for residential uses.

Recommend: Approval.

6. PDA00-088-01. Planned Development Permit Amendment to allow off-site parking arrangement for an existing church on a 2.58 gross acre site in the A(PD) Planned Development Zoning District, located at/on the southeast corner of Moorpark Avenue and Leigh Avenue (1710 MOORPARK AV) (IMMANUEL EVANGELICAL LUTHERAN CHURCH, NO NAMES ON FILE, Owner; 1710 MOORPARK AVE., L.P., Developer). Council District 6. CEQA: Negative Declaration.

Recommend: Approval.

7. PDA91-58-006 Planned Development Permit for a project located on the east side of Glenview Drive opposite Eagle Crest Court (Lot 73) on a 1.3 gross-acre site in the A(PD) Planned Development Zoning District for the construction of one single family detached residence (A. Betpolice, Owner/Developer) Council District 10. CEQA: Mitigated Negative Declaration.

Recommend: Approval.
