The procedure for this hearing is as follows:
If you challenge these land use decisions in court, you may be limited to raising only those issues you or someone else raised at this public hearing or in written correspondence delivered to the City at, or prior to, the public hearing.
The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed. The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business
1. Deferrals
Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The following items are proposed to be deferred.
a. The projects being considered are located on the southeast corner of Northern Road and Cross Way, on a 0.34-gross-acre site in the R-M Residence Zoning District (Richard Shwe, Owner/Developer). Council District: 6. CEQA: Exempt.
1. H00-025 SITE DEVELOPMENT PERMIT to allow construction of 10 single-family attached residence.
Recommend: Defer TO 4/9/03.
2. V02-006 DEVELOPMENT VARIANCE to reduce the front setback from 15 feet to 10 feet.
Recommend: Defer 4/9/03.
The matter of deferrals is now closed.
2. Consent
a. TR03-006. Tree Removal Permit to remove 1 Monterey Pine tree 120" in circumference on a 0.27 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 6740 Hampton Drive. (KURTZ ROBERT D AND JANICE L, Owner). Council District 10. CEQA: Exempt.
Recommend: Approval.
b. TR03-008. Tree Removal Permit to remove 1 Monterey Pine tree 100" in circumference on a 3.2 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the northeast corner of Gunston Way and Wyrick Avenue (1919 GUNSTON WY). (CAMBRIAN PARK METHODIST CHURCH, CAMBRIAN PARK UNITED METHODIST CHURCH, Owner). Council District 9. CEQA: Exempt.
Recommend: Approval.
c. TR03-012. Tree Removal Permit to remove 1 Liquidambar tree 80" in circumference on a 0.15 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 1671 Fairwood Avenue. (GRAHAM HUGH H AND BUTLER-GRAHAM SUSAN, Owner). Council District 9. CEQA: Exempt.
Recommend: Approval.
d. TR02-142. Tree Removal Permit to legalize the removal of a previously removed tree, greater than 56" in circumference, type unknown, on a 0.12 gross acre site in the R-2 Two-Family Residence Zoning District, located at/on the 1188 South 10th Street (1188 S 10TH ST). (JAIME SALVADOR SR AND MARIA L TRUSTEE, Owner). Council District 3. CEQA: Exempt. Deferred from 2/12/03.
Recommend: Approval.
e. TR02-115. Tree Removal Pemit to remove 1 Monterey Pine tree/103"C on a 0.16 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 2391 Downing Avenue. (Ms Maia Crowell, Owner). Council District 6. CEQA: Exempt.
Recommend: Approval.
f. TR02-125. Tree Removal Permit to remove 1 Oak tree, measuring 126 inches in circumference on a 0.16 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at 2339 Cory Avenue. (TOW JANICE L, Owner). Council District 6. CEQA: Exempt.
Recommend: Approval.
f. The projects being considered are located at the north side of Willow Glen Way, approximately 100 feet easterly of Cross Way, on a 0.12-gross-acre site in the RM Multi Family Residential Zoning District (Richard and Alma Shwe, Owner; Richard and Alma Shwe, Developer). Council District 6. CEQA: Exempt.
1. H00-018 Site Development permit for construction of a 1, 586 square foot duplex.
Recommend: Approval.
2. V02-007 Development Variance to reduce the front setback requirement from 15 feet to 10 feet.
Recommend: Approval.
g. PDA01-075-01. Planned Development Amendment Permit to allow relocation of a garage ramp for a previously approved multi-family residential building on a 0.79 gross acre site in the A(PD) Planned Development Zoning District, located at/on the northwest corner of Magliocco Drive and Huff Avenue (MIGDAL, MARK, Owner). Council District 6. CEQA: Mitigated Negative Declaration.
Recommend: Approval.

3. Public Hearings
a. SP02-058. Special Use Permit to demolish an existing and construct a new accessory structure (2 car garage/workshop) of 728 square feet at a single-family residential lot on a 0.15 gross acre site in the R-2 Two-Family Residence Zoning District, located at/on the west side of Spencer Avenue approximately 260 feet southerly of West Virginia Avenue (831 SPENCER AV) (HAWKINS TRANEL AND HERNDON-HAWKINS MELONEE, Owner). Council District 3. CEQA: Exempt.
Recommend: Approval.
b. PD03-008. Planned Development Permit to construct 93,313 square foot addition to the previously approved 339,930 square foot parking garage on a 3.46 acre site and to limit access from Hemlock Avenue to Hatton Street to emergency vehicle access only in the A(PD) Planned Development Zoning District, located at/on the east side of Winchester Boulevard, approximately 360 feet southerly of Stevens Creek Boulevard (3030 STEVENS CREEK BL) (FRIT SAN JOSE TOWN & COUNTRY VILLAGE, LLC JAN W. SWEETNAM, Owner; RJS & ASSOCIATES Mr Bob Simmons, Developer). Council District 6. CEQA: Use of a Master EIR. Deferred from 2/19/03.
Recommend: Approval.
c. The projects being considered are located at the southeast corner of Miller and Asbury Streeta, on a 0.89-gross-acre site in the A(PD) Planned Development Zoning District (Green Valley Corp, Owner/Developer). Council District 3. CEQA: Negative Declaration.
1. PD02-061. Planned Development Permit for a mixed use project consisting of up to 67 attached dwelling units and 6,600 sq.ft. of groundfloor commercial uses.
Recommend: Approval.
2. PT02-101. Tentative Condominium Map for the consolidation of 6 parcels into one lot for residential and commercial uses.
Recommend: Approval.
d. SP03-001. Special Use Permit to allow the conversion of half of a garage into living quarters to a legal non-conforming four-plex on a 0.25 gross acre site in the LI Light Industrial Zoning District, located at/on the west side of South Sixth Street approximately 40 feet northerly of East Humbolt Street (1193 S 6TH ST) (PASCOAL ANTONINO E AND MARY J TRUSTEE, Owner). Council District 3. CEQA: Exempt.
Recommend: Approval.
e. H02-065. SITE DEVELOPMENT PERMIT for a project located at the southeasterly corner of Naglee Avenue and Dana Avenue on a 0.55-gross-acre site in the R-1-8 Residential Zoning District to allow demolition of the existing Rosegarden Branch Library and construction of a new two-story, 19,195 square foot branch library. (San Jose Unified School District, Owner; City of San Jose, Developer) Council District 6. CEQA: Exempt.
Recommend: Approval.
f. RA02-006. REQUEST FOR REASONABLE ACCOMMODATION for a project located at 215 Arbor Valley Court, on a 0.15-gross-acre site, in the R-1-8 Residence Zoning District, for a residential recovery program (clean and sober living environment) for a total of 12 residents, including 2 resident staff members. (Robert Norton, et al, Owner; Support Systems Homes, Inc., Applicant.) Council District 2. CEQA: Exempt.
Recommend: Approval.
g. SP02-079. Special Use Permit to allow improvements to a legal non-conforming duplex on a 0.22 gross acre site in the CN Neighborhood Commercial Zoning District, located at/on the west side of Delmas Avenue approximately 160 feet southeasterly of Willow Street (1115 DELMAS AV) (SCHATZEL GREG, Owner). Council District 6. CEQA: Exempt.
Recommend: Approval.
h. The projects being considered are located on the south side of Meredith Avenue approximately 230 feet easterly of Lincoln Avenue, on a 0.07-gross-acre site in the R-1-8 Residence Zoning District (San Jose Conservation Corps, Owner/Developer). Council District 06. CEQA: Exempt.
1. SP02-081 SPECIAL USE PERMIT to allow a reduction in the number of covered parking spaces for a single-family detached residence from two to one.
Recommend: Approval.
2. V02-022 DEVELOPMENT VARIANCE to allow a reduction in the required 60 foot setback for detached garages to 49 feet.
Recommend: Approval.
