The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. a. HP03-001. HISTORIC PRESERVATION PERMIT for a project located at 869 South First Street on a 0.23-gross-acre site in the LI Light Industrial Zoning District for exterior alterations to The 5 Spot Drive-In Restaurant (City Landmark #HL02-121). (David G. Silva, Owner and Developer). Council District 3. CEQA: Exempt. Deferred from 2/12/03.

Recommend: Approval.

b. HP03-003. HISTORIC PRESERVATION PERMIT for a project located at 1600 Naglee Avenue on an 11-gross-acre site in the R-1-8 Residential Zoning District for alterations to The Municipal Rose Garden (City Landmark No. HS95-102). (City of San Jose, Owner and Developer). Council District 6. CEQA: Exempt.

Recommend: Approval.

c. SP02-083. Special Use Permit to allow demolition of existing single-family residence on a 0.51 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the east side of Cottle Avenue approximately 70 feet southwesterly of Glenwood Avenue (1588 COTTLE AV) (Travis Hoopes & Leonardo Augustin Owner/Developer). Council District 6. CEQA: Exempt.

Recommend: Approval.

d. PTE97-024-03. Tentative Map Extension Permit to allow extension of the previously approved permit PT97-024 to reconfigure 6 parcels into 5 lots for industrial use on a 107.6 gross acre site in the A(PD) Planned Development Zoning District, located at/on the southeast corner of Yerba Buena Road and Fowler Road (Berg & Berg Enterprises, Owner). Council District 8. CEQA: Use of a Master EIR.

Recommend: Approval.

e. TR02-142. Tree Removal Permit to legalize the removal of a previously removed tree, greater than 56" in circumference, type unknown, on a 0.12 gross acre site in the R-2 Two-Family Residence Zoning District, located at/on the 1188 South 10th Street (1188 S 10TH ST). (JAIME SALVADOR SR AND MARIA L TRUSTEE, Owner). Council District 3. CEQA: Exempt. Deferred from 2/12/03 and 2/26.03.

Recommend: Approval.

f. PDA91-58-006 Planned Development Permit for a project located on the east side of Glenview Drive opposite Eagle Crest Court (Lot 73) on a 1.3 gross-acre site in the A(PD) Planned Development Zoning District for the construction of one single family detached residence (A. Betpolice, Owner/Developer) Council District 10. CEQA: Mitigated Negative Declaration. Deferred from 1/22/03, 1/29/03, 2/12/03, and 2/19/03.

Recommend: Approval.

g. SP03-006. Special Use Permit to allow temporary outdoor use for a carnival in the parking lot of a retail shopping center on a 12.98 gross acre site in the CN Neighborhood Commercial Zoning District, located on the south side of Story Road approximately 500 feet northeasterly of King Road (1824 STORY RD) (Redevelopment Agency of the City of San Jose, Owner). Council District 5. CEQA: Exempt.

Recommend: Approval.

h. H02-020. Site Development Permit to allow construction of 2,654 square foot addition and remodeling to an existing retail store on a 0.51 gross acre site in the CG General Commercial Zoning District, located at/on the southeast corner of Story Road and Hopkins Drive (2010 STORY RD) (DAI MINH DUC, LLC, Owner). Council District 5. CEQA: Exempt.

Recommend: Approval.

i. SP03-005. Special Use Permit to allow a 5,635 square foot expansion of an existing legal non-conforming vocational training facility within an existing office building on a 7.7 gross acre site in the CO Office Commercial Zoning District, located on the north side of Blackford Avenue, approximately 1100 feet east of Saratoga Avenue (4030 Moorpark Ave, Ste. 230, 231 and 241). (IRP Muller Pacific Properties LLC, Owner/Developer). Council District 1. CEQA: Exempt.

Recommend: Approval.

j. PDA90-015-02 PLANNED DEVELOPMENT PERMIT AMENDMENT to legalize outdoor recreational activities (racetrack for radio control toy cars) on a 9.3-gross-acre site in the A(PD) Planned Development Zoning District, located at the Southeast corner of Bollinger Road and Miller Avenue (Marchese Family Properties, Owner; Hobby World, Developer). Council District: 1. CEQA: Exempt. Deferred from 2/12/03 and 2/19/03.

Recommend: Denial.

k. RA02-006. REQUEST FOR REASONABLE ACCOMMODATION for a project located at 215 Arbor Valley Court, on a 0.15-gross-acre site, in the R-1-8 Residence Zoning District, for a residential recovery program (clean and sober living environment) for a total of 12 residents, including 2 resident staff members. (Robert Norton, et al, Owner; Support Systems Homes, Inc., Applicant.) Council District 2. CEQA: Exempt. Continued from 2/26/03.

Recommend: Approval.
