The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business

 

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The following items are proposed to be deferred.

a. H01-063. Site Development Permit to allow the addition of a 1,260 square foot second residential unit to an existing single family detached residence on a 0.16 gross acre site in the R-2 Two-Family Residence Zoning District, located at the southeast corner of North 15th Street and East St. James Street (196 N 15TH ST) (Kuen-Yuan Chiou, Owner). Council District 3. CEQA: Exempt.

Recommend: Defer to 5/ /03.

2. Consent

a. H03-013. Site Development Permit to allow the construction of a 3,915 square foot maintenance building for an existing Santa Clara Valley Water District water treatment plant on a 23.5 gross acre site in the R-1-8 Single-Family Residence Zoning District, located on the northeast corner of Vista Del Mar and Whitman Way (3959 WHITMAN WY) (S C V W D, Owner/Developer). Council District 4. CEQA: Exempt.

Recommend: Approval.

b. SP02-050. Special Use Permit to allow the operation of a recycling facility that processes cooking oil into biodiesel on a 1.0 gross acre site in the HI Heavy Industrial Zoning District, located at/on the east side of Kruse Drive approximately 150 feet southerly of Brennan Street (2150 KRUSE DR) (SOUTHERN PACIFIC PIPELINES INC, Owner). Council District 4. CEQA: Exempt.

Recommend: Approval.

c. TR03-028. Tree Removal Permit to remove 1 Silver Maple tree approximately 82 inches in circumference on a 0.14 gross acre site in the R-1-8 Single-Family Residential Zoning District, located at 3180 Mattos Avenue. (KARRIS JOHN G, Owner/Applicant). Council District 4. CEQA: Exempt.

Recommend: Approval.

d. TR03-029. Tree Removal Permit to remove 4 Eucalyptus trees ranging in size from 68-108 inches in cirumference on a 0.34 gross acre site in the R-1-5 Single-Family Residence Zoning District, located at 3868 Suncrest Avenue. (YU PAUL L AND ANNETTE A TRUSTEE, SPOLAR DONALD, Owner). Council District 4. CEQA: Exempt.

Recommend: Approval.

e. PDA75-031-01. Planned Development Permit Amendment to remove 1 Oak tree/174 inches in circumference on a 9.33 gross acre site in the R-1-8(PD) Planned Development Zoning District, located at/on the northwest corner of Blossom Hill Road and Walnut Blossom Drive (229 BLOSSOM HILL ROAD). (Blossom Hill Associates, Owner). Council District 2. CEQA: Exempt.

Recommend: Approval.

f. TR03-020 TREE REMOVAL PERMIT to allow removal of one Pine tree 66 inches in circumference on a 0.14-acre site in the R-1-8 Single-Family Residence Zoning District, located at 1148 Littleoak Circle (Natarajan And Chitra Shankar, Owners). Council District: 1. CEQA: Exempt.

Recommend: Approval.

g. The projects being considered are located on a 60.2-acre site in the A(PD) Planned Development Zoning District, on the south side of Curtner Avenue approximately opposite Stone Avenue (MTA Properties LP, Owner; Summerhill Homes, Developer). Council District: 7. CEQA: Mitigated Negative Declaration

1. PD03-004 PLANNED DEVELOPMENT PERMIT to allow rough grading, public right-of-way construction, and creation of private lots for future development of up to 425 single-family and multi-family attached and detached residential units to follow under separate subsequent permits.

Recommend: Approval.

2. PT03-007 TENTATIVE SUBDIVISION MAP to subdivide one parcel into 425 lots for residential and open space uses.

h. PDA00-018-01. Planned Development Permit Amendment to allow installation of an ATM at an existing bank/retail store on a 12.5 gross acre site in the A(PD) Planned Development Zoning District, located at/on the southeast corner of Technology Drive and Skyport Drive (EOP - SKYPORT I LLC, Applicant/Owner). Council District 3. CEQA: Exempt.

Recommend: Approval.

i. HP03-003. HISTORIC PRESERVATION PERMIT for a project located at 1600 Naglee Avenue on an 11-gross-acre site in the R-1-8 Residential Zoning District for alterations to The Municipal Rose Garden (City Landmark No. HS95-102). (City of San Jose, Owner and Developer). Council District 6. CEQA: Exempt. Deferred from 3/12/03.

Recommend: Approval.

j. The projects being considered are located at the west side of North 4th Street approximately 150 feet northerly of Hensley Avenue (465 North 4th Street), on a 0.15-gross-acre site in the R-M Multiple Residence Zoning District (Chris and Michelle McSorley, Owner/Developer). Council District 3. CEQA: Exempt.

1. HP03-005. Historic Preservation Permit to allow exterior modification of an existing duplex, and construction of 504 square foot detached garage in the Hensley Historic District (HD-86-37.

Recommend: Approval.

2. H03-009. Site Development Permit to convert an existing duplex to single-family detached residential use.

Recommend: Approval.

k. PDA72-033-01. Planned Development Permit Amendment to remove 2 Eucalyptus trees 70 & 87 inches in circumference, 2 Liquidambar trees 57 & 77 inches in circumference, 1 Monterey Pine tree 76 inches in circumference, 1 Privet tree 58 inches in circumference, and 2 Canary Island Pine trees 59 & 66 inches in circumference on a 27.4 gross acre site in the R-1-5(PD) Planned Development Zoning District, located at/on the southeast, southwest, and northeast corners of Hamilton Avenue and Gaton Drive (1701 CHERRYHILLS LN). l. TR03-023. Tree Removal Permit to remove 1 Monterey Pine tree/157 inches in circumference on a 0.15 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 1185 Blewett Avenue. (GRAF THERESE H TRUSTEE, Owner). Council District 6. CEQA: Exempt.

m. TR03-017. Tree Removal Permit to remove 1 Sequoia tree/129" circumference on a 0.14 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 821 Plaza Drive. (BENEVENTO NORVELLE R TRUSTEE, Owner). Council District 6. CEQA: Exempt.

n. TR03-026. r. TR03-030. a. SP02-071. Special Use Permit to allow the direct transfer of compostable materials from containerized refuse vehicles to enclosed transfer trailers on a 6.03 gross acre site in the HI Heavy Industrial Zoning District, located at/on the west side of Old Oakland Road, directly across from Service Street (1333 OAKLAND RD) (GREENTEAM OF SAN JOSE, Owner). Council District 4. CEQA: Negative Declaration.

Recommend: Approval.

b. SP02-070. Special Use Permit to allow the direct transfer of compostable materials from containerized refuse vehicles to enclosed transfer trailers on a 2.94 gross acre site in the HI Heavy Industrial Zoning District, located on the northwest corner of Charles Street and North 13th Street (575 CHARLES ST) (GREENTEAM OF SAN JOSE, Owner). c. The projects being considered are located on the southeast corner of Northern Road and Cross Way, on a 0.34-gross-acre site in the R-M Residence Zoning District (Richard Shwe, Owner/Developer). Council District: 6. CEQA: Exempt.

1. H00-025 SITE DEVELOPMENT PERMIT to allow construction of 10 single-family attached residence. Deferred from 2/26/03.

2. V02-006 DEVELOPMENT VARIANCE to reduce the front setback from 15 feet to 10 feet. Deferred from 2/26/03.

d. H02-060. Site Development Permit to allow construction of a 9,700 square foot building for medical and dental office uses on a 0.62 gross acre site in the CP Pedestrian Commercial Zoning District, located at/on the west side of North Bascom Avenue approximately 150 feet southerly of Forest Avenue (Mr BARRY MIRKIN, Owner; Barry Mirkin, Developer). e. H03-007. Site Development Permit to construct a hazardous materials storage enclosure at an existing industrial building on a 178.46 gross acre site. in the IP Industrial Park Zoning District, located at the northeasterly corner of Highway 85 & Cottle Road (5600 COTTLE RD) (HITACHI GLOBAL STORAGE TECHNOLOGIES, Owner). f. SF03-005. Single Family House Permit to demolish a 1,416 square foot residence and construct a 3,010 square foot two-story single family residence on a 0.13 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the north side of Laurie Avenue approximately 650 feet easterly of Lincoln Avenue (1035 LAURIE AV) (PHILLIPS KENNETH F AND ANNA M, Owner). Council District 6. CEQA: Exempt.
