The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business

 

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The following items are proposed to be deferred.

2. Consent

a. PDA75-031-01. Planned Development Permit Amendment to remove 1 Oak tree/174 inches in circumference on a 9.33 gross acre site in the R-1-8(PD) Planned Development Zoning District, located at/on the northwest corner of Blossom Hill Road and Walnut Blossom Drive (229 BLOSSOM HILL ROAD). (Blossom Hill Associates, Owner). Council District 2. CEQA: Exempt. Deferred from 4/16/03.

Recommend: Approval.

b. PDA02-021-01 PLANNED DEVELOPMENT PERMIT AMENDMENT to allow minor architectural and landscaping revisions to a previously approved Planned Development Permit for up to 90 single-family attached residential units. The subject site is a 4-acre parcel in the A(PD) Planned Development Zoning District, located on the north side of Hillsdale Avenue approximately 1,000 feet northerly of the northern terminus of Vistapark Drive (currently undeveloped portion of Communications Hill, blocks 12-13). MTA Hillsdale LLP & Long Kwei, Owners; KB Home, Developer. Council District: 7. CEQA: Environmental Impact Report, City Council Resolution No. 70194.

Recommend: Approval.

c. The projects being considered are located at/on northerly terminus of Silence Drive, south of Pleasant Knoll Drive (3606 Pleasant Knoll Drive), in the A(PD) Planned Development Zoning District (Robson Homes LLC, Owner; Santa Clara Development, Developer). Council District 8. CEQA: Re-use of Negative Declaration.

1. PD03-020. Planned Development Permit to construct 6 single-family detached residences on a 1.58 gross acre site.

Recommend: Approval.

2. PT03-032. Planned Development Tentative Map Permit to subdivide 4 lots into 6 lots for single-family detached residential uses on a 1.58 gross acre site.

Recommend: Approval.

d. PDA97-015-02. Planned Development Permit Amendment to convert 555 square feet of existing church multi-use room to pre-school use for up to 15 children per session on a 14.4 gross acre site in the A(PD) Planned Development Zoning District, located at/on the west side of San Felipe Road, opposite Harvest Estates Drive (5111 San Felipe Road) (Roman Catholic Bishop of San José, Owner). Council District 8. CEQA: Addendum to Negative Declaration.

Recommend: Approval.

e. SP03-009. Special Use Permit to allow temporary outdoor display and sale of cars on a 59.76 gross acre site (Eastridge Shopping Center) in the CG General Commercial Zoning District, located at/on the northeast parking area of Eastridge Mall near the intersection of Capitol Expressway and Tully Road (1 Eastridge Mall) (Eastridge Shopping Center LLC, Owner). Council District 8. CEQA: Exempt.

Recommend: Approval.

f.  PD02-076. Planned Development Permit to allow construction of a private bridge across Quimby Creek on a 3.87 gross acre site in the A(PD) Planned Development Zoning District, located at/on the southeast corner of Murillo Avenue and Chaboya Road (4434 Chaboya Road) (Pfeiffer Ranch Investors Allen Pinn, Owner). Council District 8. CEQA: Re-use ESP EIR Reso. No. 63179.

Recommend: Approval.

The consent calendar is now closed.

3. Public Hearings

a. V03-001. Development Variance request to allow 530 square-feet of conditioned second-story floor area with a bathroom constructed in an accessory structure without benefit of permits on a 0.19 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the east side of Bird Avenue approximately 490 feet northeasterly of Snyder Avenue (1023 BIRD AV) (Stan M. Davis, Owner). Council District 6. CEQA: Exempt.

Recommend: Denial.

b. HP02-018 & SP02-082. HISTORIC PRESERVATION PERMIT & SPECIAL USE PERMIT to demolish an unpermitted third unit, to revert back to duplex, and to construct 204 square foot addition to an existing legal non-conforming duplex on a 0.12 gross acre site located at 390 North Third Street in the LI Light Industrial Zoning District. (Sarah Gama-Santiago, Owner). Council District 3. CEQA: Exempt.

Recommend: Approval.

c. The projects being considered are located at the southeast corner of Russo Drive and Cherryview Lane, on a 4.18-gross-acre site in the A(PD) Planned Development Zoning District (John E. Giacomazzi, Owner; Roem Development Corp, Developer). Council District 9. CEQA: Negative Declaration.

1. PDSH03-007. Planned Development Permit to construct 126 senior housing units and 24 single-family detached court-home residences.

Recommend: Approval.

2. PT02-078. Tentative Parcel Map to subdivide 1 parcel into 2 lots for residential use.

Recommend: Approval.

3. PT02-079. Tentative Subdivision Map to subdivide 1 of above parcel into 24 lots for residential use.

Recommend: Approval.

d. PDA89-033-02. Planned Development Permit Amendment to construct 24 fermentation tanks in a 5,000 square foot enclosure and to allow site improvements to an existing brewery on a 3.19 gross acre site in the A(PD) Planned Development Zoning District, located at the northeast corner of North 8th Street and East Taylor Street (401 E TAYLOR ST) (CP-2 ASSOCIATES, L.P., Owner; BARRY SWENSON BUILDER, Developer). Council District 3. CEQA: Exempt.

Recommend: Drop.

e. PD02-081. Planned Development Permit to construct a 14,181 square foot addition to an existing 6,136 square foot retail (grocery) store on a 0.69 gross acre site in the A(PD) Planned Development Zoning District, located at/on the northeast corner of Keyes Street and South 10th Street (455 KEYES ST) (T & T PROPERTY INC, Owner). Council District 3. CEQA: Exempt.

Recommend: Approval.
