The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. a. TR02-131. Tree Removal Permit to remove one (1) Pine tree, 86" in circumference, on a 0.12 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at 1722 Florida Avenue. (Mr Eleazar Borrayo, Owner). Council District 7. CEQA: Exempt.

Recommend: Approval.

b. TR03-032. Tree Removal Permit to remove 1 Black Walnut tree (144 inches in circumference) on a 0.14 gross acre site in the R-M Multiple Residence Zoning District, located on the southeast corner of Newhall Street and Park Avenue (2098 PARK AV). (Michael Clothier, Owner/Developer). Council District 6. CEQA: Exempt.

Recommend: Approval.

c. TR03-027. Tree Removal Permit to remove three Monterey Pine trees ranging from 84 to 96 inches in circumference on a 0.23 gross acre lot in the R-1-8 Single-Family Residence Zoning District, located at/on the 1226 Minnesota Avenue. (SMITH WILLIAM B, Owner). Council District 6. CEQA: Exempt.

Recommend:  Approval.

d. PD03-021. Planned Development Permit to allow the operation of a 6,000 square foot banquet facility, which includes the sale of alcohol for on-site consumption, within an existing 53,000 square foot warehouse/office building on a 4.01 gross acre site in the A(PD) Planned Development Zoning District, located on the south side of Murphy Avenue approximately 400 feet easterly of Oakland Road (1180 MURPHY AV) (Bob Dhillon, Owner/ Developer). Council District 4. CEQA: Exempt.

Recommend: Approval.

e. T02-110. Tentative Map Permit to subdivide 1 parcel into 4 lots for industrial use on a 15.81 gross acre site in the IP Industrial Park Zoning District, located on the northwest corner of Montague Expressway and Trimble Road (2520 JUNCTION AV) (BRE/PCCP ORCHARD LLC, Owner). Council District 4. CEQA: Exempt.

Recommend: Approval.

f. T02-109. Tentative Map Permit to subdivide 2 parcels into 4 lots for industrial use on a 16.71 gross acre site in the IP Industrial Park Zoning District, located on the northwest corner of Dagget Drive and Zanker Road (81 DAGGETT DR) (BRE/PCCP ORCHARD LLC, Owner). Council District 4. CEQA: Exempt.

Recommend: Approval.

g. TR03-029. Tree Removal Permit to remove 4 Eucalyptus trees ranging in size from 68-108 inches in cirumference on a 0.34 gross acre site in the R-1-5 Single-Family Residence Zoning District, located at 3868 Suncrest Avenue. (YU PAUL L AND ANNETTE A TRUSTEE, SPOLAR DONALD, Owner). Council District 4. CEQA: Exempt.  Deferred from 4/9/03.

Recommend: Approval.

3. Public Hearings

a. HA02-032-01. SITE DEVELOPMENT PERMIT AMENDMENT for a project located on the east side of Coleman Avenue approximately 1,900 feet northerly of Newhall Street on a 4.9-gross-acre site in the HI Heavy Industrial Zoning District for the addition of 6,905 square feet, modification to the orientation of the building location, and revisions to the elevation and landscaping (City of San Jose Airport Department, Owner; AvBase San Jose, LLC, Developer) Council District 03. CEQA: EIR Resolution 67380.

Recommend: Approval.

b. H03-010. Site Development Permit to allow installation of a new 3,900 gallon nitrogen tank on an existing concrete pad on a 4.60 gross acre site in the IP Industrial Park Zoning District, located at/on the west side of Orchard Parkway, approximately 800 feet northerly of Plumeria Drive (3001 ORCHARD PY) (Renco Associates Gene Gerald Hodnefield, Owner). Council District 4. CEQA: Exempt.

Recommend: Approval.

c. The projects being considered are located on the south side of E. San Fernando Street, approximately 100 feet westerly of Bush Street (183 BUSH ST), in the A(PD) Planned Development Zoning District (CAHILL SOUTH LLC, Owner). Council District 6. CEQA: Final EIR.

1. PDA01-007-01. Planned Development Permit Amendment to revise the unit type and architecture for a previously approved permit to construct 60 single-family attached residences.

Recommend: Approval.

2. PT02-133. Planned Development Tentative Map Permit to consolidate 5 parcels into 3 lots including a 1 lot condominium for single-family attached residential and public park uses on a 2.59 gross acre site.

Recommend: Approval.

d. H02-014. Site Development Permit to allow addition of two units to an existing multi-family residential complex on a 1.21 gross acre site in the R-M Multiple Residence Zoning District, located at/on the northwest corner of Fruitdale Avenue and Southwest Expressway (1489 FRUITDALE AV) (Mr JEROME RUDDY, Owner). Council District 6. CEQA: Exempt.

e. The projects being considered are located the west side of Almaden Road approximately 2,000 feet south of Alma Avenue, on a 4.96-gross-acre site in the A(PD) Planned Development Zoning District (Almaden Family Apartments, LP, Owner/Developer). Council District 07. CEQA: Mitigated Negative Declaration.

1. PD01-010 Planned Development Permit to allow 225 multi-family attached residential units.

Recommend: Approval.

2. PT01-104 Tentative Map to reconfigure two lots for residential and parkland uses.

Recommend: Approval.

f. H02-069. Site Development Permit to construct a 11,150 square-foot addition to an existing 4,788 square-foot retail store on a 0.56 gross acre site in the CP Commercial Pedestrian Zoning District, located at/on the west side of Union Avenue, approximately 230 feet southerly of Woodard Road (3725 UNION AV) (KAPADIA HITESH AND DIVYA, KAPADIA HITESH AND DIVYA, Owner). Council District 9. CEQA: Exempt.

Recommend: Approval.

g. The projects being considered are located at the southwest corner of Curtner Avenue and Custer Drive (2535 Custer Drive) on a .93 gross-acre site in the A(PD) Planned Development Zoning District (Dan McNiff, Owner, DeMattei & Cullen LLC, Developer). Council District 9. CEQA: Negative Declaration.

1. PD02-028. PLANNED DEVELOPMENT PERMIT to allow the construction of a five (5) new single-family detached residential units and a garage addition to an existing single family house.

Recommend: Approval.

2. PT02-051. TENTATIVE MAP to subdivide 1 parcels into 6 lots for single-family detached residential units.

Recommend: Approval.

h. PDA91-58-006 Planned Development Permit for a project located on the east side of Glenview Drive opposite Eagle Crest Court (Lot 73) on a 1.3 gross-acre site in the A(PD) Planned Development Zoning District for the construction of one single family detached residence (A. Betpolice, Owner/Developer) Council District 10. CEQA: Mitigated Negative Declaration. Deferred from 1/22/03, 1/29/03, 2/12/03, 2/19/03, 3/12/03, 3/19/03, and 3/26/03.

Recommend: Approval.
