The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business

 

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The following items are proposed to be deferred.

a. TR03-029. Tree Removal Permit to remove 4 Eucalyptus trees ranging in size from 68-108 inches in cirumference on a 0.34 gross acre site in the R-1-5 Single-Family Residence Zoning District, located at 3868 Suncrest Avenue. (YU PAUL L AND ANNETTE A TRUSTEE, SPOLAR DONALD, Owner). Council District 4. CEQA: Exempt. Deferred from 4/9/03, 4/23/03, and 4/30/03.

Defer to 5/28/03.

The matter of deferrals is now closed.

2. Consent

a. PDA83-002-02. Planned Development Permit Amendment to allow the removal of 4 Monterey Pine trees (ranging from 63-71 inches in circumferece) at an existing attached residential project on approximately 11.35 gross acres. in the A(PD) Planned Development Zoning District, located at/on the northeast corner of Tully Road and Lucretia Avenue (995 TULLY RD) (Greentree/Tully Road Partners, A Cal Ltd Pt, Owner). Council District 7. SNI: Tully/Senter. CEQA: Exempt.

Recommend: Approval.

b. PDA79-085-01. Tree Removal Permit to allow the removal of 4 Redwood trees (ranging from 63-82 inches in circumference), 2 Ash trees (ranging from 66-94 inches in circumference), and 1 Deodar Cedar (63 inches in circumference) on an existing 3.7 gross-acre, commercial site. in the A(PD) Planned Development Zoning District, located on the southwest corner of Cottle Avenue and Beswick Drive (5801 COTTLE RD) (Edwards-Holmgren, Owner). Council District 2. CEQA: Exempt.

Recommend: Approval.

c. TR03-036. Tree Removal Permit to remove 1 California Pepper tree/179 inches in circumference on a 10.47 gross acre site in the R-MH Mobilehome Park Zoning District, located at/on the northeast corner of Shadow Creek Drive and Narvaez Avenue (633 Shadow Creek Dr). (Brandenberg, Staedler & Moore, Owner). Council District 10. CEQA: Exempt.

Recommend: Approval.

d. H03-019. Site Development Permit to allow re-issuance of an expired permit (File No. H00-029) for the construction of 2 enclosure areas, totaling 408 square feet, for storage and trash at an existing restaurant (Denny's) on a 0.45 gross acre site in the CG General Commercial Zoning District, located at/on the west side of Alvin Avenue approximately 200 feet southerly of Tully Road (2401 Lanai Ave) (Jacava Properties, Owner / Developer). Council District 7. CEQA: Exempt.

Recommend: Approval.

e. TR02-090. TREE REMOVAL PERMIT for a project located at 6646 Barnsdale Court on a 0.17-gross-acre site in the A(PD) Planned Development Zoning District for the removal of 2 redwood trees 76.5 and 77.5 inches in circumference. (Albert M. and Barbara J. Avery Owner/ Developer) Council District 10. CEQA: Exempt.

Recommend: Approval.

f. TR02-131. Tree Removal Permit to remove two (2) Pine trees, measuring 76" and 86" in circumference on a 0.12 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 1722 Florida Avenue. (Mr Eleazar Borrayo, Owner). Council District 7. CEQA: Exempt.

Recommend: Approval.

g. HA87-091-01 SITE DEVELOPMENT PERMIT AMENDMENT to demolish an existing movie theater and replace with a surface parking lot to serve existing retail and office uses. The project site is a 5.5-acre parcel in the CG Commercial General Zoning District, located on the southwest corner of Steven Creek Boulevard and Lopina Way (4400 Stevens Creek Boulevard). Meridian Square Investors Of San Jose, Owner/Developer. Council District 1. CEQA: Exempt.

Recommend: Approval.

h. TR03-041 TREE REMOVAL PERMIT to remove two (2) Pine trees approximately 104 inches in circumference on 0.14-acre site in the R-M Multiple Residence Zoning District, located at 808 Opal Drive. (Eric Eyers, owner). Council District: 1. CEQA: Exempt. Recommend: Approval. TR03-034 TREE REMOVAL PERMIT to remove one (1) Pine tree 56 inches in circumference on a 0.2-acre site in the R-1-8 Single-Family Residence Zoning District, located at 1024 Cynthia Lane (Rajagopalan And Subhasri Dhesikan, owners). Council District 1. CEQA: Exempt.

Recommend: Approval.

3. Public Hearings

a. T02-136. Tentative Map Permit to subdivide 1 parcel into 5 lots for single-family detached residential uses on a 1.07 gross acre site in the R-1-8 Residence Zoning District, located at/on the northeast corner of Blossom Hill Road and Cahalan Avenue (Lyon Co William The, Owner). Council District 10. CEQA: Exempt.

Recommend: Approval.

b. H01-063. Site Development Permit to allow the addition of a 1,260 square foot second residential unit to an existing single family detached residence on a 0.16 gross acre site in the R-2 Two-Family Residence Zoning District, located at the southeast corner of North 15th Street and East St. James Street (196 N 15TH ST) (Kuen-Yuan Chiou, Owner). Council District 3. CEQA: Exempt. Deferred from 4/9/03.

Recommend: Withdrawn.

c. PT03-034. Planned Tentative Map Permit to subdivide 1 parcel into 3 lots for parking and commercial uses at Santana Row on a 5.75 gross acre site in the A(PD) Planned Development Zoning District, located on the east side of Winchester Boulevard, approximately 360 feet southerly of Stevens Creek Boulevard (3030 STEVENS CREEK BL) (FRIT SAN JOSE TOWN & COUNTRY VILLAGE LLC ET, Owner/Developer). Council District 6. CEQA: Re-use of Negative Declaration.

Recommend: Approval.

d. H02-062. Site Development Permit to construct 23,060 square foot building for medical office uses on a 1.0 gross acre site in the CO Office Commercial Zoning District, located at/on the southwest corner of Forest Avenue and Ciro Avenue (2140 FOREST AV) (Cseuz Kalman A J & Judy Trustee, Owner; Barry Swenson Builder, Developer). Council District 6. CEQA: Exempt.

Recommend: Approval.
