The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. a. TR03-042. Tree Removal Permit to remove two Coast Live Oak trees 32 and 66 inches in circumference and one Monterey Pine tree 85 inches in circumference on a 2.99 gross acre site. in the A(PD) Planned Development Zoning District, located at/on the southerly terminus of Silver Creek Valley Place (5855 SILVER CREEK VALLEY PL). Council District 2. CEQA: Exempt.

Recommend: Approval.

b. PDA81-056-01. Planned Development Permit Amendment for tree removal to remove one Ash tree approximately 66 inches in circumference a 4.9 gross acre site in the A(PD) Planned Development Zoning District, located at/on the west side of Almaden Expressway, approximately 300 feet northerly of Canoas Garden Avenue (501 SANGER WY) (Heldt Thomas E And Henrietta R, Owner). Council District 6. SNI: None. CEQA: Exempt.

Recommend: Approval.

c. SP02-031. Special Use Permit to construct a 600 square-foot detached garage to an existing legal non-conforming single-family residence on a 0.156 gross acre site in the LI Light Industrial Zoning District, located at/on the west side of South 3rd Street approximately 280 feet southerly of Martha Street (939 S 3RD ST) (Jenkins Mary B, Le Van Minh And Le Thi, Owner). Council District 3. SNI: Spartan/Keyes. CEQA: Exempt.

Recommend: Approval.

d. H02-049. Site Development Permit to allow construction of 657 square foot addition to an existing cabinet shop on a 0.12 gross acre site in the LI Light Industrial Zoning District, located at/on the southwest corner of Auzerais Avenue and Josefa Street (510 AUZERAIS AV) (Richard Wong, Owner/Applicant). Council District 3. SNI: Delmas Park. CEQA: Exempt.

Recommend: Approval.

e. HA87-091-01 SITE DEVELOPMENT PERMIT AMENDMENT to demolish an existing movie theater and replace with a surface parking lot to serve existing retail and office uses. The project site is a 5.5-acre parcel in the CG Commercial General Zoning District, located on the southwest corner of Steven Creek Boulevard and Lopina Way (4400 Stevens Creek Boulevard). Meridian Square Investors Of San Jose, Owner/Developer. Council District 1. CEQA: Exempt. Deferred from 4/30/03 and 5/14/03.

Recommend: Approval.

f. H03-005. Site Development Permit to allow a 1,200 square foot addition to a retail/commercial building for storage use (Trader Joe's) on a 8.39 gross acre site in the CG General Commercial Zoning District, located on the north side of Prospect Road, approximately 770 feet westerly of Saratoga Avenue (5269 Prospect Road) (West Valley Properties, Inc, Owner; Trader Joe's Co., Developer). Council District 1. CEQA: Exempt.

Recommend: Approval.

g. PDA83-002-02. Planned Development Permit Amendment to allow the removal of 4 Monterey Pine trees (ranging from 63-71 inches in circumferece) at an existing attached residential project on approximately 11.35 gross acres. in the A(PD) Planned Development Zoning District, located at/on the northeast corner of Tully Road and Lucretia Avenue (995 TULLY RD) (Greentree/Tully Road Partners, A Cal Ltd Pt, Owner). Council District 7. SNI: Tully/Senter. CEQA: Exempt. Deferred from 5/14/03.

Recommend: Approval.

h. V03-002. Fence Variance Permit to construct an up to 7-foot fence within 20 feet of the property lines for an existing single family detached residence on a 2.18 gross acre site. in the A Agricultural Zoning District, located at the northwest corner of Piercy Road and Hellyer Avenue (451 PIERCY RD) (Kudsi Bader S And Anne, Owner). Council District 2. SNI: None. CEQA: Exempt. Recommend: Approval.

a. PD03-012. Planned Development Permit to construct 20 single-family attached residences (condominiums) on a 1.38 gross acre site in the A(PD) Planned Development Zoning District, located at/on the west side of Bird Avenue approximately 50 feet southerly of W Virginia Street (other APN: 26443074) (615 BIRD AV) (Silva Lawrence A And Daryla D Trustee & Et, Owner; Greg Blackwell, Inc, Developer). Council District 6. SNI: Greater Gardner. CEQA: Re-use of Negative Declaration.

Recommend: Drop and Renotice.

b. PDA96-065-02. PLANNED DEVELOPMENT PERMIT AMENDMENT to enable the potential transfer of six (6) un-used traffic allocations from Evergreen Specific Plan Area ''QQ'' on a 34.98 gross acre site in the A(PD) Planned Development Zoning District, located on the southeast corner of Quimby Road and Murillo Avenue to other areas within the Evergreen Specific Plan (Sikh Gurdwara-San Jose, Owner). Council District 8. SNI: None. CEQA: Re-use of Evergreen Specific Plan EIR.

Recommend: Approval.

c. HP03-002 & H03-006. Historic Preservation Permit & Site Development Permit to recognize an existing duplex as the legal use, to allow 4 required parking spaces (2 covered and 2 open spaces), and for exterior facade improvements on a 0.145 gross acre site in the R-M Multiple Residence Zoning District, located at/on the east side of North Fourth Street approximately 400 feet south easterly of East Empire Street (458 N 4TH ST) (FRANK GEORGE AND ROBERTA TRUSTEE, Owner). Council District 3. CEQA: Exempt. Deferred from 4/16/03.

Recommend: Approval.

d. H02-062. Site Development Permit to construct 23,060 square foot building for medical office uses on a 1.0 gross acre site in the CO Office Commercial Zoning District, located at/on the southwest corner of Forest Avenue and Ciro Avenue (2140 FOREST AV) (Cseuz Kalman A J & Judy Trustee, Owner; Barry Swenson Builder, Developer). Council District 6. CEQA: Exempt. Deferred from 5/14/03.

Recommend: Approval.
