The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business

 

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The following items are proposed to be deferred.

a. PD03-024 PLANNED DEVELOPMENT PERMIT to allow demolition of an existing single-family detached residence and construction of up to three (3) single-family detached residences on a 0.23-acre site in the A(PD) Planned Development Zoning District, located on the east side of South Cypress Avenue approximately 300 feet northerly of Judro Way (392 South Cypress Avenue). Majid Mohazzab and Zahra Pourmotamed, owners. Council District: 1. SNI: None. CEQA: Exempt.

Recommend: Defer to 6/11/03.

2. Consent

a. TR03-037. Tree Removal Permit to remove one (1) Coast Live Oak 150 inches in circumference on a 0.68 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the south side of Wooded Lake Drive, approximately 220 feet westerly of Rimrock Drive. (7060 WOODED LAKE DR) (Benson Peter R And Dianne, Owner). Council District 10. SNI: None. CEQA: Exempt.

Recommend: Approval.

b. TR03-029. Tree Removal Permit to remove 4 Eucalyptus trees ranging in size from 68-108 inches in cirumference on a 0.34 gross acre site in the R-1-5 Single-Family Residence Zoning District, located at 3868 Suncrest Avenue. (YU PAUL L AND ANNETTE A TRUSTEE, SPOLAR DONALD, Owner). Council District 4. CEQA: Exempt. Deferred from 4/9/03, 4/23/03, 4/30/03, and 5/14/03.

Recommend: Approval.

c. TR03-046 TREE REMOVAL PERMIT to remove one Redwood tree, 148 inches in circumference, on a 0.15-acre site in the R-1-8 Single-Family Residence Zoning District, located at 5035 Country Lane (Leslie Thorne, owner). Council District: 1. SNI: None. CEQA: Exempt.

Recommend: Approval.

d. SP03-011 SPECIAL USE PERMIT to allow conversion of an existing single-family residence into a commercial building on a 0.6-acre site in the CP Pedestrian Commercial Zoning District, located on the west side of Saratoga Avenue approximately 200 feet northerly of Williams Road (977 Saratoga Avenue). Jackie And Nick Borina Trust, owner. Council District: 1. SNI: None. CEQA: Exempt.

Recommend: Approval.

e. PDA83-002-02. Planned Development Permit Amendment to allow the removal of 4 Monterey Pine trees (ranging from 63-71 inches in circumferece) at an existing attached residential project on approximately 11.35 gross acres. in the A(PD) Planned Development Zoning District, located at/on the northeast corner of Tully Road and Lucretia Avenue (995 TULLY RD) (Greentree/Tully Road Partners, A Cal Ltd Pt, Owner). Council District 7. SNI: Tully/Senter. CEQA: Exempt. Deferred from 5/14/03, and 5/21/02.

Recommend: Approval.

f. H03-020. Site Development Permit to allow conversion of existing two-family residence to single-family residence, in the HENSLEY HISTORIC DISTRICT on a 0.17 gross acre site in the R-M Multiple Residence Zoning District, located at/on the west side of North Fifth Street approximately 240 feet southerly of East Empire Street (483 N 5TH ST) (Robert And Alice Switzer, Owner). Council District 3. CEQA:Exempt.

Recommend: Approval.

g. TR03-039. Tree Removal Permit to remove 1 Sequoia Sempervirens Coastal Redwood tree/82 inches in circumference on 0.45 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 1475 Lupton Avenue (The Jarvis Trust, Owner). Council District 6. SNI: None. CEQA: Exempt.

Recommend: Approval.

3. Public Hearings

a. T02-117. Tentative Map Permit to subdivide 1 parcel into 6 lots for single-family detached residential use on a 1.44 gross acre site in the R-1-8 Residence Zoning District, located at/on the northwest corner of Cunningham Avenue and Cunningham Court (2837 CUNNINGHAM AV) (Pham Bao D Et Al, Kearney Billye Trustee, Owner). Council District 8. CEQA: Exempt.

Recommend: Approval.

b. H02-040. Site Development Permit to demolish an existing FAA RTR Tower Facility and a vacant restaurant and construct a 57,291 square foot aircraft hanger, 36,097 square foot terminal/office and service facility and 127,577 square foot parking facility on a 6.19 gross acre site in the HI Heavy Industrial Zoning District, located at/on the southeast corner of Coleman Avenue and Aviation Way (CITY OF SAN JOSE AIRPORT DEPT, Owner; ACM AVIATION, Developer). Council District 3. CEQA: EIR Resolution 67380. Deferred from 4/30/03.

Recommend: Approval.

c. SP03-014. Special Use Permit to allow parking lot reconfiguration and tree removal on a 1.27 gross acre site in the R-2 Two-Family Residence Zoning District, located on the south side of West Hedding Street approximately 80 feet east of Myrtle Street (877 ELM ST) (Bellarmine College Preparatory, Owner/Developer). Council District 6. SNI: None. CEQA: Exempt.

Recommend: Approval.

d. The projects being considered are located on the north side of Olsen Drive approximately 420 feet westerly of Santana Row (377 SANTANA ROW), in the A(PD) Planned Development Zoning District (FEDERAL REALTY INVESTMENT TRUST, Owner). Council District 6. SNI: None. CEQA: Exempt.

1. PD03-018. Planned Development Permit to allow off-sale of alcoholic beverages and a drinking establishment (wine tasting) in conjunction with a retail wine store at Santana Row on a 43 gross acre site.

Recommend: Approval.

2. ABC03-007. Liquor License Exception Permit to allow off-sale of alcoholic beverages at a retail wine store at Santana Row on a 43 gross acre site.

Recommend: Approval.

e. The projects being considered are located at/on west side of Bird Avenue approximately 50 feet southerly of W Virginia Street (other APN: 26443074) (615 BIRD AV), in the A(PD) Planned Development Zoning District (SILVA LAWRENCE A AND DARYLA D TRUSTEE & ET, Owner; GREG BLACKWELL, INC, Developer). Council District 6. SNI: Greater Gardner. CEQA: Mitigated Negative Declaration.

1. PD03-012. Planned Development Permit to construct 20 single-family attached residences (condominiums) on a 1.38 gross acre site.

Recommend: Approval.

2. PT03-027. Tentative Condominium Map Permit to consolidate 4 parcels into 1 lot for single-family attached residential use on a 1.38 gross acre site.

Recommend: Approval.
