The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business

 

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The consent calendar items are considered to be routine and will be adopted by one motion. There will be no separate discussion of these items unless a request is made by the Director of Planning, staff, or the public to have an item removed from the consent calendar and considered separately. If anyone in the audience wishes to speak on one of these items, please come to the podium at this time.

a. TR02-143. Tree Removal Permit to remove 1 Stone Pine tree 125 inches in circumference on a 0.3 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 1198 Chateau Drive (Wilson Lena J And Kent D, Owner). Council District 10. SNI: None. CEQA: Exempt.

Recommend: Approval.

b. H03-024. Site Development Permit to allow construction of a General Aviation Fixed Based Operator (FBO) facility containing 64,785 square feet of hangar, office space and aircraft ramp area on a 7.19 gross acre site in the HI Heavy Industrial Zoning District, located at/on the southeast corner of Brokaw Road and Martin Avenue (273 MARTIN AV) (San Jose City Of, Owner; San Jose Jet Center, Developer). Council District 4. SNI: None. CEQA: Addendum to EIR Reso. 71451.

Recommend: Approval.

c. H02-040. Site Development Permit to demolish an existing FAA RTR Tower Facility and a vacant restaurant and construct a 57,291 square foot aircraft hanger, 36,097 square foot terminal/office and service facility and 127,577 square foot parking facility on a 6.19 gross acre site in the HI Heavy Industrial Zoning District, located at/on the southeast corner of Coleman Avenue and Aviation Way (CITY OF SAN JOSE AIRPORT DEPT, Owner; ACM AVIATION, Developer). Council District 3. CEQA: EIR Resolution 67380. Deferred from 4/30/03 and 5/28/03.

Recommend: Approval.

d. PD03-024 PLANNED DEVELOPMENT PERMIT to allow demolition of an existing single-family detached residence and construction of up to three (3) single-family detached residences on a 0.23-acre site in the A(PD) Planned Development Zoning District, located on the east side of South Cypress Avenue approximately 300 feet northerly of Judro Way (392 South Cypress Avenue). Majid Mohazzab and Zahra Pourmotamed, owners. Council District: 1. SNI: None. CEQA: Exempt. Deferred from 5/28/03.

Recommend: Approval.

e. TR03-048. Tree Removal Permit to remove 1 Pine tree approximately 100 inches in circumference on a 0.22 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at 4934 Bel Canto Drive (Bidgoli Abolfazl S And Maryam G, Owner). Council District 9. SNI: None. CEQA: Exempt.

Recommend: Approval.

a. V03-003. Sign Variance Permit to install a second sign for one occupant frontage (12.25 square feet) on a coffee shop (Starbucks) on a 2.29 gross acre site in the A(PD) Planned Development Zoning District, located at/on the southwest corner of River Oaks Parkway and Village Center Drive (670 RIVER OAKS PY) (Shea River Oaks Asscs Lp, Owner). Council District 4. SNI: None. CEQA: Exempt.

Recommend: Denial.

b. PD03-013. Planned Development Permit to construct 245 multi-family attached residences on a 4.09 gross acre site in the A(PD) Planned Development Zoning District, located on the northwest corner of Stockton Avenue and Cinnabar Street (891 CINNABAR ST) (Cinnabar Commons, LLC, Owner/Developer). Council District 6. SNI: None. CEQA: Use of a Master EIR.

Recommend: Approval.

c. HP03-006. Historic Preservation Permit to allow exterior modifications to an existing retail and residential building a.k.a. Vintage Tower (HL86-39) on a 0.67 gross acre site, in the A(PD) Planned Development Zoning Distict, located at/on the northwest corner of East Santa Clara and North 6th Street (235 E SANTA CLARA ST) (City Of San Jose). Council District 3. SNI: 13th Street. CEQA: Exempt.

Recommend: Approval.

d. HP03-007. Historic Preservation Permit to rehabilitate historic building a.k.a. Overfelt House (HS85-30) for general office use on a 33 gross acre site, in the R-M Multiple Residence Zoning Distict, located at/on the northeast corner of Mabury Road and Educational Park Drive (1776 EDUCATIONAL PARK DR) (City Of San Jose Julie Mark). Council District 4. SNI: None. CEQA: Exempt.

Recommend: Approval.

e. HP03-008. Historic Preservation Permit to allow exterior changes to the previously approved permit HP02-002 for a single family detached residence in the Hensley Historic District (HD89-51) on a 0.22 gross acre site, in the R-M Multiple Residence Zoning Distict, located at/on the northwest corner of Hensley and North Fourth Streets (457 N 4TH ST) (Dudek David And Naiomi). Council District 3. SNI: 13th Street. CEQA: Exempt.

Recommend: Approval.
