If you challenge these land use decisions in court, you may be limited to raising only those issues you or someone else raised at this public hearing or in written correspondence delivered to the City at, or prior to, the public hearing.
The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed. The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

1. Deferrals
Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. d. TR03-048. b. SF03-004. Single Family House Permit to allow first and second story addition of 1,707 square feet to an existing 1-story single-family residence on a 0.14 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the east side of Hokett Way approximately 500 feet west of Shadelands Drive (6248 HOKETT WY) (Herdman Mark F And Brandy A, Owner). c. PD03-003. d. SP03-021. Special Use Permit to allow temporary outdoor use for a carnival in the parking lot of a retail shopping center on a 12.98 gross acre site in the CN Neighborhood Commercial Zoning District, located at/on the south side of Story Road approximately 500 feet northeasterly of King Road (1824 STORY RD) (City Of San Jose Redevelopment Agency, Owner). e. H02-040. Site Development Permit to demolish an existing FAA RTR Tower Facility and a vacant restaurant and construct a 57,291 square foot aircraft hanger, 36,097 square foot terminal/office and service facility and 127,577 square foot parking facility on a 6.19 gross acre site in the HI Heavy Industrial Zoning District, located at/on the southeast corner of Coleman Avenue and Aviation Way (CITY OF SAN JOSE AIRPORT DEPT, Owner; ACM AVIATION, Developer). f. V03-003. Sign Variance Permit to install a second sign for one occupant frontage (12.25 square feet) on a coffee shop (Starbucks) on a 2.29 gross acre site in the A(PD) Planned Development Zoning District, located at/on the southwest corner of River Oaks Parkway and Village Center Drive (670 RIVER OAKS PY) (Shea River Oaks Asscs Lp, Owner). g. HA96-064-02. Site Development Permit Amendment to allow for changes in site layout, landscaping and building architecture for a previously approved 329,000 square foot Research & Development (office) building and construction of a surface parking lot in the IP Industrial Park Zoning District, located at/on the the southwest corner of Guadalupe Parkway and North First Street. (2161 N 1ST ST) (Novell, Owner/eBay, Developer). Council District 4. SNI: None. CEQA: Reuse of Master EIR.
Recommend: Approval.
h. PD03-013. Planned Development Permit to construct 245 multi-family attached residences on a 4.09 gross acre site in the A(PD) Planned Development Zoning District, located on the northwest corner of Stockton Avenue and Cinnabar Street (891 CINNABAR ST) (Cinnabar Commons, LLC, Owner/Developer). Council District 6. SNI: None. CEQA: Use of a Master EIR. Deferred from 6/11/03.
Recommend: Approval.
i. SP03-017. Special Use Permit to demolish one office building and a large shed and construct a parking lot on a 0.9 acre site in the LI Light Industrial Zoning District, located on the west side of South Autumn Street approximately 510 feet south of West Santa Clara Avenue (59 S AUTUMN ST) (Johnson Marian A Trustee, Owner/ Developer). j. PD03-015. Planned Development Permit to construct up to 175 affordable, multi-family attached residential units on a 5.01 gross acre site. in the A(PD) Planned Development Zoning District, located at/on the northeasterly corner of Branham Lane East and Monterey Highway (JSM Enterprises, Developer, City Of San Jose, Owner). Council District 2. SNI: None. CEQA: Negative Declaration.
Recommend: Approval.
