The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business

 

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The following items are proposed to be deferred.

2. Consent

a. TR03-035. Tree Removal Permit to remove two previously removed pine trees, and one standing Alanthus tree, all greater than 65” in circumference, an on a 0.29 gross acre site in the R-M Multiple Residence Zoning District, located at/on the east side of South 11th Street approximately 180 feet southerly of East San Fernando Street (124 S 11TH ST) (The Church In San Jose, Owner). Council District 3. SNI: University. CEQA: Exempt.

Recommend: Approval.

b. PTE00-157-12. Planned Tentative Map Extension Permit to allow extension of the previously approved permit PT00-157 on a 0.73 gross acre site in the A(PD) Planned Development Zoning District, located at/on the southwest corner of Maxey Drive and Piedmont Road (Sunbro Llc, Kam Li, Owner). Council District 4. SNI: None. CEQA: Exempt.

Recommend: Approval.

c. H02-040. Site Development Permit to demolish an existing FAA RTR Tower Facility and a vacant restaurant and construct a 57,291 square foot aircraft hanger, 36,097 square foot terminal/office and service facility and 127,577 square foot parking facility on a 6.19 gross acre site in the HI Heavy Industrial Zoning District, located at/on the southeast corner of Coleman Avenue and Aviation Way (CITY OF SAN JOSE AIRPORT DEPT, Owner; ACM AVIATION, Developer). Council District 3. CEQA: EIR Resolution 67380. Deferred from 4/30/03, 5/28/03, 6/11/03, and 6/18/03.

Recommend: Approval.

d. PDA77-085-01 Planned Development Permit Amendment to allow removal of one (1) Eucalyptus tree approximately 68 inches in circumference on a 2.1-acre site in the A(PD) Planned Development Zoning District. The project site is located on the north side of Via Vico approximately 150 feet westerly of Weyburn Lane (7233 Via Vico). Property Owner: Wong-Young Development Corporation Applicant: Allenwood Homeowner’s Association Council District: 1 Strong Neighborhoods Initiative area: N/A. California Environmental Quality Act (CEQA) determination: Exempt.

Recommend: Approval.

The consent calendar is now closed.

3. Public Hearings

a. PD03-015. Planned Development Permit to construct up to 175 affordable, multi-family attached residential units on a 5.01 gross acre site. in the A(PD) Planned Development Zoning District, located at/on the northeasterly corner of Branham Lane East and Monterey Highway (JSM Enterprises, Developer, City Of San Jose, Owner). Council District 2. SNI: None. CEQA: Negative Declaration. Deferred from 6/18/03.

Recommend: Approval.

b. The projects being considered are located at/on southerly terminus of Basking Ridge Avenue, easterly of US 101, in the A(PD) Planned Development Zoning District (Braddock & Logan, Richard & Angie Ceraolo, and Almaden Associates, LLC, Owner). Council District 2. SNI: None. CEQA: EIR Resolution No. 71360.

1. PD03-016. Planned Development Permit to construct up to 213 single-family detached residences.

Recommend: Approval.

2. PT03-029. Vesting Planned Tentative Map Permit to subdivide three parcels into up to 213 lots for single-family detached residential uses plus one lot for open space purposes.

Recommend: Approval.

c. The projects being considered are located at/on north side of Quimby Road approximately 1,000 feet westerly of South White Road (2785 QUIMBY RD), in the A(PD) Planned Development Zoning District (SIKH-GURDWARA SAN JOSE CALIF, Owner). Council District 8. SNI: None. CEQA: Mitigated Negative Declaration.

1. PD03-027. Planned Development Permit to allow the construction of 25 single family detached residences and modifications to an existing church on a 4.8 gross acre site.

Recommend: Approval.

2. PT03-047. Vesting Planned Tentative Map Permit to subdivide 3 parcels into 26 lots for single family detached residential and church uses on a 4.8 gross acre site.

Recommend: Approval.

d. SP02-034. Special Use Permit to allow an existing 676 square-foot accessory structure (storage room and garage) on a 0.16 gross acre site in the LI Light Industrial Zoning District, located at/on the southeast corner of South 26th Street and Shortridge Avenue (54 S 26TH ST) (Dasilva Silvino P And Ema, Owner). Council District 3. SNI: Five Wounds/Brookwood Terrace. CEQA: Exempt.

Recommend: Denial.
