The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. a. SP03-015. Special Use Permit to allow the demolition of 8 buildings totalling 59,200 square feet on a 15.72 gross acre site in the CN Neighborhood Commercial, CP Pedestrian Commercial Zoning District, located at/on the southeast corner of Story and South King Roads (1604 STORY RD) (San Jose Redevelopment Agency, Owner). b. SF03-008. Single Family House Permit to construct a second story addition of 2,206 square feet on an existing 1,032 square-foot single family residence on a 0.11 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 3369 Mt Wilson Drive (Rodriguez Marcelo, Owner/Developer). Council District 5. SNI: None. CEQA: Exempt.

Recommend: Approval.

a. PD03-002. Planned Development Permit for construction of a 1,500 square foot addition to an existing 60,300 square-foot retail shopping center (Canyon Creek Plaza) on an 8.3 gross acre site in the A(PD) Planned Development Zoning District, located at/on the west side of Silver Creek Valley Road approximately 640 feet northeasterly of Bel Aire Hills Drive (5601 Silver Creek Valley Rd.) b. PDA02-069-01. Planned Development Permit Amendment to approve the architecture for one (1) single-family detached residence on a 3.4 gross acre site in the A(PD) Planned Development Zoning District, located at/on the south terminus of Cortona Court approximately 520 feet southerly of Cortona Drive (4146 Cortona Ct) (Leo Guiterrez, Owner; Gabe Reyes, Applicant). Recommend: Approval.

c. The projects being considered are located at/on south side of Quimby Road, approximately 1,700 feet easterly of Ruby Avenue (3300 QUIMBY RD), in the A(PD) Planned Development Zoning District (East Side Union High School District, Owner; Citation Homes, Developer). 1. PD03-010. Planned Development Permit to construct 45 single-family detached residences on a 13.0 gross acre site.

Recommend: Approval.

2. PT03-014. Vesting Planned Tentative Map Permit to subdivide 1 parcel into 46 lots for single-family detached residential uses and open space on a 13.0 gross acre site.

Recommend: Approval.

d. The projects being considered are located at/on northwest corner of Capitol Expressway and Timberloop Drive, in the A(PD) Planned Development Zoning District (Credit Suisse Leasing 92A LP, Owner). Council District 10. SNI: N/A. CEQA: Addendum to Waterford EIR Reso. No. 64433.

1. PD02-077. Planned Development Permit to construct 1,500 square foot building for drive-thru cafe (Starbucks) on a 11.87 gross acre site.

2. PT03-050. Planned Development Tentative Map to reconfigure 3 parcels into 2 lots for commmercial use on a 11.87 gross acre site.

Recommend: Approval.

e. PDA02-014-04. Planned Development Permit Amendment for revised architecture within Neighborhood “C” on a 562.2 gross acre site in the A(PD) Planned Development Zoning District, located at/on the easterly side of Highway 101, approximately 1,000 feet northerly of Hellyer Avenue (Tract 9166) (William Lyon Homes, Inc. f. The projects being considered are located at/on north side of Quimby Road approximately 1,000 feet westerly of South White Road (2785 QUIMBY RD), in the A(PD) Planned Development Zoning District (SIKH-GURDWARA SAN JOSE CALIF, Owner). 1. PD03-027. Planned Development Permit to allow the construction of 25 single family detached residences and modifications to an existing church on a 4.8 gross acre site. Deferred from 6/25/03.

2. PT03-047. Vesting Planned Tentative Map Permit to subdivide 3 parcels into 26 lots for single family detached residential and church uses on a 4.8 gross acre site. Deferred from 6/25/03.

g. H03-018. Site Development Permit to construct 1,270 square foot addition to an existing single family residence and convert single-family residential use to duplex on a 0.21 gross acre site in the R-2 Two-Family Residence Zoning District, located at/on the west side of North 34th Street, approximately 130 feet northerly of East James Street (225 N 34TH ST) (Guido Driora, Owner). h. H03-028. Site Development Permit to construct a 100 square foot addition to an existing dental office building on a 2.4 gross acre site in the CO-Office Commercial Zoning District, located at/on the northeast corner of Cahalan Avenue and Chemeketa Drive (5710 CAHALAN AV Bldg 8) (Wong Andrew K And Margaret K, Sunrise Investment Company, Charles E. i. PDA91-006-58. Planned Development Amendment to allow construction of a 8,236-square-foot two-story single-family detached residence on a 1.3-gross-acre site in the A(PD) Planned Development Zoning District, located at/on the East side of Glenview Drive opposite Eagle Crest Court (lot 73) (7196 GLENVIEW DR) (Abraham Betpolice, Owner). j. SF03-006. Single-Family House Permit to allow 2,340 square-foot addition to an existing 1,442 square-foot single-family house on a 0.15 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the southwest corner of Bolado Drive and Bernal Road (7025 BOLADO DR) (Guerrero, Jaime And Maria C, Owner). k. PD02-030. Planned Development Permit to allow up to 90 single-family attached residences on a 6.2-acre site within the Communications Hills Specific Plan area. The project site is in the A(PD) Planned Development Zoning District, located on the north side of Hillsdale Avenue approximately 1,000 feet northerly of the northern terminus of Vistapark Drive (currently undeveloped portion of Communications Hill, blocks 10-11). l. PDA77-085-01. Planned Development Permit Amendment to allow removal of one (1) Eucalyptus tree approximately 68 inches in circumference on a 2.1-acre site in the A(PD) Planned Development Zoning District. The project site is located on the north side of Via Vico approximately 150 feet westerly of Weyburn Lane (7233 Via Vico). Property Owner: Wong-Young Development Corporation Applicant: Allenwood Homeowner’s Association Council District: 1 Strong Neighborhoods Initiative area: N/A. California Environmental Quality Act (CEQA) determination: Exempt. Deffered from 6/25/03.

m. TR03-045. Tree Removal Permit to remove 1 Pecan tree/144 inches in circumference on a 0.14 gross acre single family detached residential site. in the R-1-8 Residence Zoning District, located at 5897 Pontius Court (5897 PONTIUS CT) (Summy Thomas L, Owner). Council District 2. SNI: None. CEQA: Exempt.

Recommend: Approval.

n. PDA98-016-05. Planned Development Permit Amendment to allow a two-year time extension of a Permit that provided architectural details for a previously approved church on an approximately 51 gross acre site in the A(PD) Planned Development Zoning District, located on the easterly side of Monterey Highway, approximately 1,600 feet easterly of the intersection of Monterey Highway and Skyway Drive. (South Valley Christian Church, Owner). Council District 2. SNI: None. CEQA: EIR Resolution No. 65245.

Recommend: Approval.

o. The projects being considered are located at/on southerly terminus of Basking Ridge Avenue, easterly of US 101, in the A(PD) Planned Development Zoning District (Braddock & Logan, Richard & Angie Ceraolo, and Almaden Associates, LLC, Owner). Council District 2. SNI: None. CEQA: EIR Resolution No. 71360.

1. PD03-016. Planned Development Permit to construct up to 213 single-family detached residences. Deferred from 6/25/03.

Recommend: Approval.

2. PT03-029. Vesting Planned Tentative Map Permit to subdivide three parcels into up to 213 lots for single-family detached residential uses plus one lot for open space purposes. Deferred from 6/25/03.

Recommend: Approval.
