If you challenge these land use decisions in court, you may be limited to raising only those issues you or someone else raised at this public hearing or in written correspondence delivered to the City at, or prior to, the public hearing.

The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business

 

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The following items are proposed to be deferred.

2. Consent

a. PT03-006. Planned Tentative Condominium Map Permit to consolidate 6 parcels into 1 lot for 65 single-family attached residential uses on a 0.94 gross acre site in the A(PD) Planned Development Zoning District, located at/on the southeast corner of Madden Avenue and South Jackson Avenue (2322 MADDEN AV) (Falk David L, Developer). Council District 5. SNI: None. CEQA: Re-use of Negative Declaration.

Recommend: Approval.

b. PDA77-085-01. Planned Development Permit Amendment to allow removal of one (1) Eucalyptus tree approximately 68 inches in circumference on a 2.1-acre site in the A(PD) Planned Development Zoning District. The project site is located on the north side of Via Vico approximately 150 feet westerly of Weyburn Lane (7233 Via Vico). Property Owner: Wong-Young Development Corporation Applicant: Allenwood Homeowner’s Association Council District: 1 Strong Neighborhoods Initiative area: N/A. California Environmental Quality Act (CEQA) determination: Exempt. Deffered from 6/25/03 and 7/9/03.

Recommend: Approval.

3. Public Hearings

a. SP02-034. Special Use Permit to allow an existing 676 square-foot accessory structure (storage room and garage) on a 0.16 gross acre site in the LI Light Industrial Zoning District, located at/on the southeast corner of South 26th Street and Shortridge Avenue (54 S 26TH ST) (Dasilva Silvino P And Ema, Owner). Council District 3. SNI: Five Wounds/Brookwood Terrace. CEQA: Exempt. Deferred from 6/25/03.

Recommend: Approval.

b. SF03-006. Single-Family House Permit to allow 2,340 square-foot addition to an existing 1,442 square-foot single-family house on a 0.15 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the southwest corner of Bolado Drive and Bernal Road (7025 BOLADO DR) (Guerrero, Jaime And Maria C, Owner). Council District 2. SNI: None. CEQA: Exempt. Deferred from 7/9/03.

Recommend: Approval.

c. PD03-033. Planned Development Permit to allow health club uses in 38,650 square feet of an existing building at Santana Row on a 1.78 gross acre site in the A(PD) Planned Development Zoning District, located on the eastside of South Winchester Boulevard approximately 400 feet north of Tisch Way (360 S WINCHESTER BL) (Federal Realty Investment Trust, Owner). Council District 6. SNI: None. CEQA: Use of Final EIR. Recommend: Approval.

Recommend: Approval.
