The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. a. TR03-063. Tree Removal Permit to remove 1 Ash tree 89 inches in cirumference on a 0.18 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 627 Iroquois Court (Harris Frederick And Cira, Owner). Council District 10. SNI: None. CEQA: Exempt.

Recommend: Approval.

b. TR03-059. Tree Removal Permit to remove 1 Coast Live Oak tree 65 inches in circumference on a 1.5 gross acre site in the A(PD) Planned Development Zoning District, located at/on the 2580 South Bascom Avenue (Craig Gardens Senior Housing Jamie Artery, Owner). Council District 9. SNI: None. CEQA: Exempt.

Recommend: Approval.

c. H02-036. Site Development Permit to allow the construction of tenant improvements including an office space addition, a new recreation room, a new maintenance room, and a new storage shed totaling 900 square feet, as well as the removal of a handicap ramp, and an exit door at an existing multi-family residence on a 4.26 gross acre site in the R-M Multiple Residence Zoning District, located at the southwest corner of Mueller and North Capitol Avenues (175 N CAPITOL AV) (Capitol Manor Inc, Owner). Recommend: Approval.

d. TR03-049. Tree Removal Permit to remove two Camphor Trees 108 & 111 inches in circumference on a 0.23 gross acre site in the R-1-5 Single-Family Residence Zoning District, located at/on the east side of James Place approximately 300 feet southerly of Dry Creek Road (1942 JAMES PL) (Yules Kenneth P, Owner). Council District 6. SNI: None. CEQA: Exempt. Recommend: Approval.

3. Public Hearings

a. SF03-012. Single Family House Permit to construct 2nd floor addition of 1,623 square feet to 1-story single family detached residence of 1,872 square feet on a 0.15 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 2561 Malaga Drive (Espinola David And Noelia C, Owner). Council District 9. SNI: None. CEQA: Exempt.

Recommend: Approval.

b. SP02-034. Special Use Permit to allow an existing 676 square-foot accessory structure (storage room and garage) on a 0.16 gross acre site in the LI Light Industrial Zoning District, located at/on the southeast corner of South 26th Street and Shortridge Avenue (54 S 26TH ST) (Dasilva Silvino P And Ema, Owner). Council District 3. SNI: Five Wounds/Brookwood Terrace. CEQA: Exempt. Deferred from 6/25/03 and 7/16/03.

c. H03-026. Site Development Permit to allow construction of a 2,760 square foot duplex on a 0.17 gross acre site in the R-M Multiple Residence Zoning District, located on the northerly side of Wabash Street, approximately 380 feet westerly of Essex Street. (1342 WABASH ST) (Ortiz, Jose F And Luz Trustee, Owner). Council District 4. SNI: None. CEQA: Exempt.

d. SF03-006. Single-Family House Permit to allow 2,740 square-foot addition to an existing 1,442 square-foot single-family house on a 0.15 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the southwest corner of Bolado Drive and Bernal Road (7025 BOLADO DR) (Guerrero, Jaime And Maria C, Owner). Council District 2. SNI: None. CEQA: Exempt. Deferred from 7/9/03 and 7/16/03.

Recommend: Approval.

e. The projects being considered are located at/on the west side of Mount Pleasant Road approximately 500 feet northerly of Marten Avenue (1777 MT PLEASANT RD,) on a 0.6 gross acre site in the R-1-8 Single-Family Residence Zoning District, (Nguyen Danny D And Phan Binh Thanh Et Al, Owner). 1. SP03-012. Special Use Permit to allow demolition of a 700 square foot accessory structure.

Recommend: Approval.

2. T02-062. Tentative Map Permit to allow subdivision of one parcel into three lots for residential use.

f. PD03-011. Planned Development Permit to construct 40 single-family attached live-work and loft residences, a parking structure and off-site parking arrangements for an existing office building on a 1.6 gross acre site in the A(PD) Planned Development Zoning District, located at/on the northeasterly corner of The Alameda and North Morrison Avenue (919 THE ALAMEDA) (Green Valley Corporation, Owner). Council District 6. SNI: None. CEQA: Negative Declaration.

Recommend: Approval.

g. SP01-035. Special Use Permit to demolish the administrative annex complex and replace with 18th dynasty Egyptian gardens on a 4.96 gross acre site in the R-1-8 Single-Family Residence Zoning District, located on the southeast corner of Naglee and Park Avenues (1342 NAGLEE AV) (Rosicrucian Park Julie Scott, Owner). Council District 06. SNI: None. CEQA: Exempt.

Recommend: Approval.

h. PD03-033. Planned Development Permit to allow health club uses in 38,650 square feet of an existing building at Santana Row on a 1.78 gross acre site in the A(PD) Planned Development Zoning District, located on the eastside of South Winchester Boulevard approximately 400 feet north of Tisch Way (360 S WINCHESTER BL) (Federal Realty Investment Trust, Owner). Council District 6. SNI: None. CEQA: Use of Final EIR. Deferred from 7/16/03.

Recommend: Approval.

i. H03-029. Site Development Permit for a public park with a play area, basket ball court and picnic area on a 0.65 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the northeast corner of Lone Bluff Way and Capitol Expressway (Dept Of Public Works City Of San Jose, Owner). Council District 7. SNI: None. CEQA: Addendum to EIR. Recommend: Approval.
