If you challenge these land use decisions in court, you may be limited to raising only those issues you or someone else raised at this public hearing or in written correspondence delivered to the City at, or prior to, the public hearing.

The Planning Director's action on these agenda items is final when the permit is signed and mailed, unless the permit is appealed.  The Planning Director's actions are appealable in accordance with the requirements of Title 20 0f the Municipal Zoning Code.

Order of Business

 

1. Deferrals

Any item scheduled for hearing this evening for which deferral is being requested will be taken out of order to be heard first on the matter of deferral. A list of Staff-recommended deferrals is available on the Press Table. If you want to change any of the deferral dates recommended, or speak to the question of deferring these or any other items, you should say so at this time. I will now open the public hearing. The following items are proposed to be deferred.

2. Consent

a. TR03-004. Tree Removal Permit to remove 1 Monterey Pine tree 98 inches in circumference on a 0.18 gross acre site in the R-1-5 Single-Family Residence Zoning District, located at/on the 957 Shadow Brook Drive (Mason James W And Betty A, Owner). Council District 10. SNI: None. CEQA: Exempt.

Recommend: Approval.

b. V03-007. Development Variance Permit to reduce front setback to less than the required 60 feet for construction of a 212 square foot addition and replacement of a detached garage to an existing single family detached residence on 0.17 gross acre lot in the R-1-8 Single-Family Residence Zoning District, located at/on the northly terminus of Chabrant Way (918 CHABRANT WY) (Nichols Betty J Trustee, Owner). Council District 6. SNI: None. CEQA: Exempt.

Recommend: Approval.

3. Public Hearings

a. The projects being considered are located at the east side of McKean Road approximately 5,500 feet south of Bailey Avenue, on an 88.98 gross-acre site in the A(PD) Planned Development Zoning District (North First Street Properties Lee Brandenburg, Owner). Council District 10. SNI: None. CEQA: Negative Declaration.

1. PD02-084. Planned Development Permit to construct 2 single-family detached residences.

Recommend: Approval.

2. PT00-140. Tentative Parcel Map to subdivide 1 parcel into 2 lots for residential use.

Recommend: Approval.

b. PD03-011. Planned Development Permit to construct 40 single-family attached live-work and loft residences, a parking structure and off-site parking arrangements for an existing office building on a 1.6 gross acre site in the A(PD) Planned Development Zoning District, located at/on the northeasterly corner of The Alameda and North Morrison Avenue (919 THE ALAMEDA) (Green Valley Corporation, Owner). Council District 6. SNI: None. CEQA: Negative Declaration. Deferred from 7/23/03.

Recommend: Approval.

c. SF03-011. Single Family House Permit to construct first floor addition of 383 square feet and second floor addition of 1,108 square feet resulting in a 3,109 square foot two-story single-family residence on a 0.13 gross acre site in the R-1-8 Single-Family Residence Zoning District, located at/on the 1275 Oxton Drive (Douangphachanh Phanthavong And Nguyen Anh-T, Owner). Council District 7. SNI: None. CEQA: Exempt.

Recommend: Approval.
