The procedure for this hearing is
as follows:
- Hearing Officer will identify the
project as described on the agenda.
- Staff Report.
- After the staff report, the
applicant and/or representative should make themselves known as their item comes up by
approaching the microphone and identifying themselves and stating their home address, or
just wave from the audience if you do not wish to speak..
- Public testimony, either for or
against the project. Please state your name and home address for the record.
- The Hearing Officer may ask
questions of the speaker.
- After the public testimony, the
applicant may make closing remarks.
- The public hearing will then be
closed and the Planning Director will take action on the item. The Planning Director
may request staff to respond to the public testimony, ask staff questions, and discuss the
item.
If you challenge these land
use decisions in court, you may be limited to raising only those issues you or someone
else raised at this public hearing or in written correspondence delivered to the City at,
or prior to, the public hearing.
The Planning Director's action
on these agenda items is final when the permit is signed and mailed, unless the permit is
appealed. The Planning Director's actions are appealable in
accordance with the requirements of Title 20 0f the Municipal Zoning Code.

1. Deferrals
Any item scheduled for hearing this
evening for which deferral is being requested will be taken out of order to be heard first
on the matter of deferral. A list of Staff-recommended deferrals is available on the Press
Table. If you want to change any of the deferral dates recommended, or speak to the
question of deferring these or any other items, you should say so at this time. I will now

Development Permit Amendment to allow removal of 8 Eucalyptus trees, varying in sizes
between 61 to 91 inches in circumference, on a 25.15 gross acre site in the A(PD) Planned
Development Zoning District, located at the northwest corner of Alexian Drive and Jose
Figueres Avenue (117 POAS CL) (Park Mckee Homeowners Association, Owner/Developer).
Council District 5. SNI: None. CEQA: Exempt.
Recommend: Approval.
- H02-064. Site Development Permit
to allow construction of a 26,000 square-foot library and on-site parking on a 1.82 gross
acre site in the CN Neighborhood Commercial and CP Pedestrian Commercial Zoning Districts,
located at the southwest corner of Alum Rock Avenue and South White Road (3076 ALUM ROCK
AV) (City Of San Jose, Owner/Developer). Council District 5. SNI: East Valley/680
Communities. CEQA: Negative Declaration.
Recommend: Approval.
- TR03-057. Tree Removal Permit
to remove 4 Pinus Canariensis trees 85 inches, 2 Fraxinus Velutina trees 65-85 inches, and
1 Juglans Californica tree 95 inches in circumference on a 20.94 gross acre site in the
R-M Multiple Residence Zoning District, located at/on the south and north sides of Cherry
Avenue approximately 600 feet westerly of Almaden Expressway (4950 CHERRY AV) (Cherry
Avenue Development Co, Owner). Council District 9. SNI: None. CEQA: Exempt.
Recommend:
Approval.
- TR03-053. Tree Removal Permit
to remove 1 Monterey Pine tree 140 inches in circumference on a 0.16 gross acre site in
the R-1-8 Single-Family Residence Zoning District, located at/on the 2794 Lantz Avenue
(Stratton Letitia A, Owner). Council District 9. SNI: None. CEQA: Exempt.
Recommend:
Approval.

- V03-008. Development Variance
Permit to reduce the front setback of an existing legal non-conforming single-family
detached residence from 21 to 18 feet on a 0.12 gross acre lot in the CO Office Commercial
Zoning District, located on the southerly side of Schiele Avenue approximately 600 feet
easterly of The Alameda (986 SCHIELE AV) (Caselli Ronald A, Owner). Council District 6.
SNI: None. CEQA: Exempt.
Recommend: Denial.
- SP03-028. Special Use Permit
to allow a church sponsored special event (festival/carnival) on a 8.9 gross acre site in
the R-1-1 Single-Family Residence Zoning District, located at/on the east side of Pearl
Avenue approximately 140 feet north of Koreza Drive (4848 PEARL AV) (Roman Catholic Bishop
Of San Jose, Owner). Council District 9. SNI: None. CEQA: Exempt.
Recommend: Approval.
- SP02-034. Special Use Permit
to allow an existing 676 square-foot accessory structure (storage room and garage) on a
0.16 gross acre site in the LI Light Industrial Zoning District, located at/on the
southeast corner of South 26th Street and Shortridge Avenue (54 S 26TH ST) (Dasilva
Silvino P And Ema, Owner). Council District 3. SNI: Five Wounds/Brookwood Terrace. CEQA:
Exempt. Deferred from 6/25/03, 7/16/03, 7/23/03, and 8/13/03.
Recommend: Denial.
