Notice to
the Public
The procedure for this hearing is
as follows:
- Hearing Officer will identify the
project as described on the agenda.
- Staff Report.
- After the staff report, the
applicant and/or representative should make themselves known as their item comes up by
approaching the microphone and identifying themselves and stating their home address, or
just wave from the audience if you do not wish to speak..
- Public testimony, either for or
against the project. Please state your name and home address for the record.
- The Hearing Officer may ask
questions of the speaker.
- After the public testimony, the
applicant may make closing remarks.
- The public hearing will then be
closed and the Planning Director will take action on the item. The Planning Director
may request staff to respond to the public testimony, ask staff questions, and discuss the
item.
If you challenge these land
use decisions in court, you may be limited to raising only those issues you or someone
else raised at this public hearing or in written correspondence delivered to the City at,
or prior to, the public hearing.
The Planning Director's action
on these agenda items is final when the permit is signed and mailed, unless the permit is
appealed. The Planning Director's actions are appealable in
accordance with the requirements of Title 20 0f the Municipal Zoning Code.

1. Deferrals
Any item scheduled for hearing this
evening for which deferral is being requested will be taken out of order to be heard first
on the matter of deferral. A list of Staff-recommended deferrals is available on the Press
Table. If you want to change any of the deferral dates recommended, or speak to the
question of deferring these or any other items, you should say so at this time. I will now

2. Consent
- PDA70-022-01. Planned
Development Permit Amendment to allow removal of 8 Eucalyptus trees, varying in sizes
between 61 to 91 inches in circumference, on a 25.15 gross acre site in the A(PD) Planned
Development Zoning District, located at the northwest corner of Alexian Drive and Jose
Figueres Avenue (117 POAS CL) (Park Mckee Homeowners Association, Owner/Developer).
Council District 5. SNI: None. CEQA: Exempt. Deferred from 8/20/03.
Recommend:
Approval.
- TR03-066 TREE REMOVAL PERMIT
to remove one Ash tree, 75 inches in circumference, on a 0.14-acre site in the R-1-8
Single-Family Residence Zoning District, located at 4071 West Rincon Avenue (Fredrick and
Cindra Paup, Owner). Council District 1. SNI: None. CEQA: Exempt.
Recommend:
Approval.

3. Public Hearings
- H03-042. Site Development Permit
to construct a 9,000 square foot skate park facility within an existing park (WATSON PARK)
on a 37.5 gross acre site in the R-1-8 Single-Family Residence Zoning District, located
at/on the north and south sides of Jackson Street, west side of Highway 101 (City of San
Jose, Owner). Council District 3. SNI: Thirteenth Street. CEQA: Exempt.
Recommend: Approval.
- SF03-009. Single Family House
Permit to demolish a 1,066 square foot single family residence and construct a new
2,747 square foot single family residence in the R-1-8 Single-Family Residence Zoning
District, located at/on the 1334 Spencer Avenue (Warda David M And Donna E, Owner).
Council District 6. SNI: None. CEQA: Exempt. Deferred from 8/13/03.
Recommend: Approval.
- The projects being considered are located on a 56.6-gross-acre site in the A(PD) Planned
Development Zoning District, located at/on the west side of Santa Teresa Boulevard
approximately 300 feet northerly of Blossom Hill Road (Oakridge Mall LLC,
Owner/Developer). Council District: 10. CEQA: Re-use of a previous Environmental Impact
Report (resolution #70459, as amended on June 19, 2001).
1. PDA01-089-04 PLANNED DEVELOPMENT
PERMIT AMENDMENT to allow the following at an existing commercial shopping center
(Oakridge Mall) 24-hour uses (midnight to 2:30 AM) for restaurants and a movie theater an
amusement arcade sale of alcoholic beverages at a proposed retail store (Target) for
off-site consumption.
Recommend: Approval.
2. ABC03-008 LIQUOR LICENSE EXCEPTION PERMIT for consideration of findings of public
convenience or necessity, to allow the sale of alcoholic beverages at a proposed retail
store (Target) for off-site consumption.
Recommend: Approval.
- PDA73-031-01. Planned
Development Permit Amendment to allow grading changes including the construction of a
5 to 6 foot high retaining wall in the rear yard of an existing single family detached
residence in an A(PD) Planned Development Zoning District, located on the south side of
Beckham Drive approximately 200 feet westerly of Oberlin Way (392 BECKHAM DR) (Mckinney
Jack L Jr And Kristine L, Owner). Council District 2. SNI: None. CEQA: Pending.
Recommend: Approval.
- SP02-034. Special Use Permit
to allow an existing 676 square-foot accessory structure (storage room and garage) on a
0.16 gross acre site in the LI Light Industrial Zoning District, located at/on the
southeast corner of South 26th Street and Shortridge Avenue (54 S 26TH ST) (Dasilva
Silvino P And Ema, Owner). Council District 3. SNI: Five Wounds/Brookwood Terrace. CEQA:
Exempt. Deferred from 6/25/03, 7/16/03, 7/23/03, 8/13/03, and 8/20/03.
Recommend: Approval.
