Notice to the Public

If you want to address the Commission, fill out a card (located on the table as you come in or at the technician's station), and give the completed card to the technician. Please include the agenda item number for reference.

The procedure for this hearing is as follows:

• After the staff report, applicants and appellants may make a 5-minute presentation.

• The chair will call out names on the submitted speaker cards in the order received.

• As your name is called, line up in front of the microphone at the front of the Chamber.  Each speaker will have two minutes.

• After the public testimony, the applicant and appellant may make closing remarks for an additional five minutes.

• Planning Commissioners may ask questions of the speakers.  These questions will not reduce the speaker's time allowance.

The public hearing will then be closed and the Planning Commission will take action on the item.  The Planning Commission may request staff to respond to the public testimony, ask staff questions, and discuss the item.

If you challenge these land use decisions in court, you may be limited to raising only those issues you or someone else raised at this public hearing or in written correspondence delivered to the City at, or prior to, the public hearing.

The Planning Commission's action on rezonings, prezonings, and Code Amendments is advisory only to the City Council. The City Council will hold public hearings on these items. Section 20.120.400 of the Municipal Code provides the procedures for legal protests to the City Council on rezonings and prezonings.

   CEQA: Mitigated Negative Declaration. SNI: Five Wounds/Brookwood Terrace. Council District: 3

GP 03-03-07: GENERAL PLAN AMENDMENT request to change the Land Use/Transportation Diagram designation from Medium Density Residential (8-16 Dwelling Units Per Acre (DU/AC)) on 7.7 acres and Light Industrial on an approximately 2.6 acres to Public Park and Open Space on an approximately 10.3 acre segment of the Union Pacific Railroad/Valley Transportation Authority railroad right-of-way located between Interstate 280 and 135 feet southerly of East Santa Clara Street; apply the Transit Mall designation along a 10.0 acre segment of Valley Transportation Authority railroad right-of-way located on both sides of 28th Street between Julian Street and 135 feet southerly of East Santa Clara Street on an approximately 20.3-acre site.

RECOMMEND PUBLIC PARK AND OPEN SPACE ON AN APPROXIMATELY 4.5 ACRE SEGMENT OF THE VALLEY TRANSPORTATION AUTHORITY RAILROAD RIGHT-OF-WAY LOCATED BETWEEN EAST WILLIAM STREET AND 135 FEET SOUTHERLY OF EAST SANTA CLARA STREET; APPLY THE TRANSIT MALL DESIGNATION ALONG A 10.0 ACRE SEGMENT OF VALLEY TRANSPORTATION AUTHORITY RAILROAD RIGHT-OF-WAY LOCATED ON BOTH SIDES OF 28TH STREET BETWEEN JULIAN STREET AND 135 FEET SOUTHERLY OF EAST SANTA CLARA STREET

GP 03-03-10: GENERAL PLAN AMENDMENT request to change the Land Use/Transportation Diagram designation from Residential Support for the Core Area (25+ Dwelling Units per Acre (DU/AC)) to Medium Density Residential (8-16 DU/AC) on an approximately 15.6 acres, Neighborhood/Community Commercial on an approximately 1.2 acres, Public/Quasi-public on 0.4 acre and Floating Public Park/Open Space for property located in the area generally bounded by Interstate 280, Columbia/West San Carlos Street, Bird Avenue, Delmas Avenue and State Route 87 on an approximately 17.1-acre site. (Hans P. Hager and Pacific Gas & Electric Company, Owners/City of San Jose, Applicant).

   Staff Recommendation: Adopt the proposed amendment.

GP 03-07-01: GENERAL PLAN AMENDMENT request to change the Land Use/Transportation Diagram designation from Medium Low Density Residential (8 Dwelling Units per Acre (DU/AC)) to Medium Density Residential (8-16 DU/AC) for property located on the east side of McLaughlin Avenue approximately 100 feet northerly of Candia Drive on a 0.8-acre site. (Dhillon Bhupindar S. Trustee & Et. Al., Owner/Applicant).
   CEQA: Mitigated Negative Declaration. Council District: 7.
   Staff Recommendation: Adopt the proposed amendment on an expanded 2.5-acre site.

GP 03-T-07: GENERAL PLAN TEXT AMENDMENT request to amend the text to add a new Transportation/ Aviation policy recognizing and supporting the federal government's continued operation and development of Moffett Field in a manner consistent with City and regional objectives for future civil aviation use.
