Notice to the Public

If you want to address the Commission, fill out a card (located on the table as you come in or at the technician's station), and give the completed card to the technician. Please include the agenda item number for reference.

The procedure for this hearing is as follows:

  • After the staff report, applicants and appellants may make a 5-minute presentation.

  • The chair will call out names on the submitted speaker cards in the order received.

  • As your name is called, line up in front of the microphone at the front of the Chamber.  Each speaker will have two minutes.

  • After the public testimony, the applicant and appellant may make closing remarks for an additional five minutes.

  • Planning Commissioners may ask questions of the speakers.  These questions will not reduce the speaker's time allowance.

The public hearing will then be closed and the Planning Commission will take action on the item.  The Planning Commission may request staff to respond to the public testimony, ask staff questions, and discuss the item.

If you challenge these land use decisions in court, you may be limited to raising only those issues you or someone else raised at this public hearing or in written correspondence delivered to the City at, or prior to, the public hearing.

The Planning Commission's action on rezonings, prezonings, and Code Amendments is advisory only to the City Council. The City Council will hold public hearings on these items. Section 20.120.400 of the Municipal Code provides the procedures for legal protests to the City Council on rezonings and prezonings.

  4. CP04-020.   5. CP04-029.   1. STREET Vacation. VACATION OF A PORTION OF A PUBLIC STREET. The vacation of a portion of public right-of-way of Hillsdale Avenue, between Pearl Avenue and the Guadalupe River. (Peter Smith, Applicant; Summer Hill Homes, Owner.) SNI: None. Council District 6. CEQA: Negative Declaration.

    Recommendation: Planning staff recommends that the Planning Commission review and consider the Negative Declaration for this project. Planning staff recommends that the Planning Commission recommend to the City Council approval of the proposed street vacation as recommended by Staff.

  2. STREET Vacation. VACATION OF THE WESTERLY corner OF 3002 MONTEREY ROAD, an approximately 81 square foot area located on the east side of Monterey Road approximately 650 feet northerly of Southside Drive in the LI Light Industrial Zoning District to facilitate the construction of an approved Site Development Permit (H03-022) (Mkrtich Mazlumyan, Owner; Gary Campagna, Applicant).   3. CP04-047. Conditional Use Permit to allow three (3) wireless communication antennas within a 60-foot tall monopole and associated 200 square foot on a 4.95 gross acre site in the R-1-8 Single-Family Residence Zoning District, located between Berryessa Creek and West Minister Court (San Jose Water Works, Owner; Metro PCS Mr Kersten Rutherford, Developer). Council District 4. SNI: None. CEQA: Exempt.

    Recommendation: Planning staff recommends that the Planning Commission approve the Conditional Use Permit for wireless communications antennas as recommended by Staff.

    1. CP03-062. Conditional Use Permit to allow a wireless communications monopole 60 feet in height; 12 panel antennas; 400 square-foot ancillary equipment shelter; and a standby/back-up generator in the in the R-M Multiple Residence Zoning District located in the Caltrans right-of-way at the north side of Grant Street at the intersection of Palm Street, adjacent to the Highway 280/Highway 87 interchange (State of California Department of Transportation, Owner).   • Recommendation: Planning staff recommends that the Planning Commission     approve the Conditional Use Permit for wireless communications antennas as recommended by Staff.

    1. The projects being considered are located on the east side of North Fourth Street approximately 170 feet northerly of Washington Street (424 North Fourth Street) (Neighborhood Housing Services Silicon Valley, ATTN: Edward Moncrief, Owner /Developer). Council District 3. SNI: 13th Street. CEQA: EIR PC resolution # 04-051, and addenda thereto, file number PDC04-061.

    1. PDC04-061. Planned Development Rezoning from LI Light Industrial District to A(PD) Planned Development Zoning District.

    Recommendation: Planning staff recommends that the Planning Commission find that it has considered the Final EIR for the PC resolution #04-051, and the addendum to that Final EIR dated June 9, 2004. Planning staff recommends that the Planning Commission recommend to the City Council approval of the proposed Planned Development Rezoning to accommodate the relocation of a historic resource (507 Almaden Ave.) as recommended by Staff.

    RECOMMEND APPROVAL (5-0-1-1; PLATTEN, ABSENT; CAMPOS ABSTAINED).  PULLED FROM CONSENT.

    2. PD04-051 and HP04-005. Planned Development Permit and Historic Preservation Permit to allow the relocation of the historic single-family residence from 507 Almaden Ave. to a 0.13 gross acre site in the Hensley Historic District.

    1. The project being considered is located at the southwest corner of Silver Creek and Aborn Roads rezoning from LI Light Industrial Zoning District to A(PD) Planned Development Zoning District (Li-Chu Feng & Chung-Guang Shen, Ruey-Rong & Lih-Woan Lii, Ying-Ming Huang & Chen-Huei Huang, Owners; Barry Swenson Builder, Developer). Council District 7. SNI: West Evergreen. CEQA: Mitigated Negative Declaration. Deferred from 7-28-04.

      1. PDC04-008. Protest of the Mitigated Negative Declaration.

      2. PDC04-008. Planned Development Rezoning to allow up to 70,000 square feet of retail, 50,000 square feet of medical office or an 80-bed assisted living facility for the elderly, and unimproved land to be dedicated for public park purposes on a 7.5 gross-acre site.

      Recommendation: Planning staff recommends that the Planning Commission find on the basis of the entire record before the Planning Commission that there is no substantial evidence that the project will have a significant effect on the environment, that the mitigated negative declaration reflects the independent judgment and analysis of the City, that the location and custodian of the records of these proceedings is with the Director of Planning as noted in the staff report and that the Planning Commission uphold and adopt the Mitigated Negative Declaration prepared for the project and the mitigation monitoring or reporting program. Planning staff recommends that the Planning Commission recommend to the City Council approval of the proposed Planned Development Rezoning as recommended by Staff.

      UPHELD NEGATIVE DECLARATION (6-0-1; PLATTEN ABSENT).  THE COMMISSION RECOGNIZES THAT THE EXISTING TRAFFIC CONDITION IS BAD; HOWEVER, SHOULD THE PROJECT GO IN WITH THE MITIGATION  (TRANSPORTATION IMPROVEMENTS) IT MAY GET A LITTLE BETTER, BUT NOT SOLE THE PRE-EXISTING CONDITIONS.

      RECOMMEND APPROVAL  (6-0-1; PLATTEN ABSENT) OF THE PROPOSED PLANNED DEVELOPMENT REZONING.

    2. PDA87-072-01. APPEAL of the Planning Director’s decision to deny a Planned Development Permit Amendment to allow operation hours after midnight until 3:00 a.m. Thursdays through Saturdays at an existing restaurant on a 1.23 gross acre site, in the A(PD) Planned Development Zoning District, located at/on the southwest corner of Capitol Avenue and Sierra Grande Way (175 S. Capitol Avenue) (James Z. & Chaska C. Teng, et al, Trustee, Owner). Council District 5. SNI: East Valley/680 Communities. CEQA: Exempt.

      Recommendation: Planning staff recommends that the Planning Commission uphold the Director of Planning Decision to Deny the Planned Development Permit Amendment.

      UPHELD THE APPEAL (5-1-1; LEVY OPPOSED; PLATTEN ABSENT).  DEFERRED TO 8-25-04 FOR PREPARATION OF THE RESOLUTION.  THE COMMISSION APPROVED UNTIL 3:00 A.M. WITH A one year compliance review.  the commission felt that the proposal, in fact did MEET THE INTENT OF THE 24-HOUR POLICY AND FELT THAT THE REQUEST FOR LATE NIGHT USE WOULD BE PRIMARILY NEIGHBORHOOD SERVING.  COMMISSION LEVY PROPOSED A FRIENDLY AMENDMENT TO OVERTURN THE DIRECTOR'S DECISION AND LIIMIT THE HOURS UNTIL 2:00 A.M.  THE AMENDMENT WAS NOT ACCEPTED.  COMMISSIONERS LEVY AND ZITO EXPRESSED THEIR CONCERN WITH COMPATIBILITY AND THE PRECEDENT THIS MAY SET WITH OTHER USES IN THE CENTER.  COMMISSIONER DHILLON PROPOSED A FRIENDLY AMENDMENT THAT THERE BE A SIX MONTH COMPLIANCE REVIEW.  COMMISSIONER CAMPOS AGREED TO A ONE-YEAR COMPLIANCE REVIEW.

    3. PDC04-017. The project(s) being considered are located on the west side of North Capitol Avenue, opposite of Penitencia Creek Road (905 N Capitol Avenue) (Masato and Fusa T. Yoneda, et al, Trustee Owner; Trumark Companies, Chris Davenport, Developer). Council District 4. SNI: None. CEQA: Mitigated Negative Declaration:

      1. Planned Development Prezoning from County to A(PD) Planned Development Zoning District on approx. 5.1- acres to allow up to 113 single-family attached residences (Lands of Yoneda).

      2. Prezoning from Unincorporated County to R-M Multiple Residence District on approx. 4.2 - acres (Lands of Yoneda).

      3. Prezoning from Unincorporated County to R-M Multiple Residence District on approx. 1.76 gross acres (Lands of Chelstowski).

      Recommendation: Planning staff recommends that the Planning Commission review and consider the Mitigated Negative Declaration for this project. Planning staff recommends that the Planning Commission recommend to the City Council approval of the proposed Planned Development Prezoning, and the two Prezonings from Unincorporated County to R-M, as recommended by Staff.

      RECOMMEND APPROVAL  (6-0-1; PLATTEN ABSENT) OF THE PROPOSED PLANNED DEVELOPMENT PREZONING, AND THE TWO PREZONINGS.  THE COMMISSION SUPPORTS THE DEVELOPMENT OF HIGHER DENSITY DEVELOPMENT ALONG CAPITOL CORRIDOR.

    4. PDC04-010. Planned Development Rezoning from A-Agriculture Zoning District to A(PD) Planned Development Zoning District to allow up to 172 single-family attached residences and a 1.3 acre public park on a 4.6 gross acre site, located on the west side of Masonic Drive, south side of Almaden Expressway (2455 MASONIC DR) (San Jose Scottish Rite Foundation, Owner; Vitoil, Inc./ Stefan Martirosian, Developer). Council District 6. SNI: None. CEQA: Mitigated Negative Declaration.

      Recommendation: Planning staff recommends that the Planning Commission review and consider the Mitigated Negative Declaration for this project. Planning staff recommends that the Planning Commission recommend to the City Council approval of the proposed Planned Development Rezoning as recommended by Staff.

      RECOMMEND APPROVAL  (6-0-1; PLATTEN ABSENT).

    5. CP04-049. Conditional Use Permit to relocate an existing city owned 126 foot monopole with six city emergency communication antenna’s 10 feet away from the current location, increase its height by 10 feet to 136.3 feet, and construct a fifty square foot utility and equipment structure, six feet in height on a City owned corporatioin yard of approximately 7.74 gross acres. The site is located in the R-1-8 Single-Family Residence Zoning District on southwesterly side of Williams Road, approximately 450 feet southerly of Moorpark Road (5090 Willliams Road)(City of San Jose, Owner).       Recommendation: Planning staff recommends that the Planning Commission approve the Conditional Use Permit for wireless communications antennas as recommended by Staff.

    5. CONTINUATION OF PLANNING COMMISSION SUMMER HEARING ON GENERAL PLAN AMENDMENTS FROM JULY 28, 2004

     

    6. GENERAL PLAN CONSENT CALENDAR

    1. GP03-05-04, UGB03-01. GENERAL PLAN AMENDMENT request to change the Land Use/Transportation Diagram to allow expansion of the Urban Service Area and a minor expansion of the Urban Growth for property located at the north side of Fleming Avenue (1230 and 1238 Fleming Avenue) between Impresario Way and Warner Drive on a two-acre site (Carl & Helen Gunnels Trust, Owners; Mark Thomas & Company, Applicant). The General Plan Land Use/Transportation Diagram designation of Non-Urban Hillside is not proposed to change. Council District: 5. SNI: None. CEQA: Mitigated Negative Declaration, GP03-05-04.

      Recommendation: Planning staff recommends that the Planning Commission review and consider the Mitigated Negative Declaration prepared for this project. Planning staff recommends that the Planning Commission recommend to the City Council approval of the proposed General Plan amendment as recommended by staff.

    7. GENERAL PLAN PUBLIC HEARING CALENDAR

    1. The items being considered are located on the southwest corner of Lundy Avenue and McKay Drive at (1240 and 1290 McKay Drive and 1750 Ringwood Avenue) on a 17.38-acre site (Philips Semiconductors Inc., Sobrato Inc, Owners/The Riding Group, Applicant).       1. FINAL ENVIRONMENTAL IMPACT REPORT for a General Plan Amendment (GP03-04-04) to change the City of San Jose General Plan Land Use/Transportation Diagram designation to Medium High Density Residential (12-25 DU/AC) and a Planned Development Rezoning (PDC04-001) to rezone the subject site from IP-Industrial Park Zoning District to A(PD) Planned Development Zoning District to allow up to 313 single family attached condominium and townhouse residences.

      2. GP03-04-04. GENERAL PLAN AMENDMENT request to change the Land Use/Transportation Diagram designation from Industrial Park to Medium High Density Residential (12-25 DU/AC).

      3. PDC04-001. Planned Development Rezoning from IP Industrial Park Zoning District to A(PD) Planned Development Zoning District to allow up to 304 single-family attached residences.

      Recommendation: Planning staff recommends that the Planning Commission find that the Final EIR prepared for this project has been completed in compliance with and conforms to the requirements of CEQA and that the Final EIR reflects the City’s independent judgment and analysis. The Planning Commission further directs staff to forward and present the certified Final EIR to the City Council for review and consideration. Planning staff recommends that the Planning Commission recommend to the City Council denial of the proposed General Plan amendment as recommended by Staff. Planning staff recommends that the Planning Commission recommend to the City Council that, should the General Plan amendment as proposed be approved, conditional approval of the proposed Planned Development Rezoning as recommended by Staff.

      Recommendation: Planning staff recommends that the Planning Commission review and consider the Mitigated Negative Declaration prepared for this project. Planning staff recommends that the Planning Commission recommend to the City Council denial of the proposed General Plan Amendment as recommended by staff. Planning staff recommends that the Planning Commission recommend to the City Council that should the General Plan Amendment as proposed be approved, conditional approval of the Planned Development Rezoning as recommended by staff.
