The City Council adopted Ordinance No. 28284 to amend Title 20 of the San Jose Municipal Code (the Zoning Code) to establish requirements for secondary units (granny units) that reflect the parameters tested in the Secondary Unit Pilot Program. The City Council also adopted a resolution revising the Schedule of Parkand In-Lieu Fees charged pursuant to Chapters 14.25 and 19.38 of the San Jose Municipal Code to establish park impact fees for secondary units equal to 50 percent of the fees applicable to single room occupancy (SRO) units. The permanent secondary unit ordinance is effective June 15, 2008.
Ordinance No. 21663 On May 15, 1984, the City Council adopted an ordinance precluding secondary units within the City of San Jose.

Ordinance No. 27606 On November 29, 2005, the City Council adopted an ordinance to allow a limited pilot program for secondary units and the associated suspension of park impact fees, effective January 2006 through December 31, 2006. The pilot program allowed for up to 100 permits for new secondary units and also allows any existing units that comply with the approved requirements to obtain a secondary unit permit.
Ordinance No. 27932 On December 12, 2006, the City Council adopted an ordinance to extend the secondary unit pilot program and the associated suspension of park impact fees for an additional six months, to June 30, 2007, to allow for up to 100 permits for new secondary units, whichever comes first.
Ordinance No. 28055 On June 5, 2007, the City Council adopted an ordinance to extend the secondary unit pilot program and the associated suspension of park impact fees to October 31, 2007 to allow for up to 100 permits for new secondary units, whichever comes first.
Ordinance No. 28149 On October 23, 2007, the City Council adopted an ordinance to extend the secondary unit pilot program and the associated suspension of park impact fees for an additional six months, to April 30, 2008, to allow for up to 100 permits for new secondary units, whichever comes first. The ordinance also includes minor changes to the pilot program parameters.
