If the accessory building or structure is 120 sq. ft. or less, no permit is required unless it includes electricity or plumbingA building permit is required:

  • If the size is greater than 120 sq. ft. (as measured from exterior walls).
  • If it includes electricity or plumbing, no matter the size. 
  • If over 650 sq. ft., both a building permit and special use permit are required.

DEFINITIONS

Accessory buildings are defined in the Municipal Code as non-livable and enclosed, including: sheds, playhouses, and detached garages. Does not include livable accessory dwelling units (ADUs).

Accessory structures have open-air construction, including: gazebos, trellises, and pools, spas and hot tubs.

Why a permit is vital - To protect your safety and property, it is vital that projects comply with current California building codes. A City inspector will check for code compliance. Note: Insurance companies may deny claims related to unpermitted work.

Who can apply? We recommend that the applicant be a licensed contractor. See Who Can Apply for a Building Permit for others who may apply. Whoever signs the building permit application is responsible and potentially liable for all activity under the permit. See Owner-Builders Beware!

How to Apply

  • Over-the-Counter (OTC) - Use this faster, lower-cost service if the project qualifies. 
  • Residential Express - Provides expedited review of your uploaded plans and the permit is issued during a virtual meeting. Unlike OTC, it accommodates projects with engineered trusses and simple lateral loads. A premium fee will apply. 
  • Standard Plan Review - For projects that do not qualify for the above services.

Inspections

You will be issued a Permit Card that lists required inspections. Schedule inspections at SJPermits.org or call 408-535-3555 for assistance. 

Be ready — read Inspection Success.

  • The Permit Card must always be on-site and available to the Inspector. 
  • Have plans and manufacturer instructions, if any, available.
  • Ensure there is access to the work area; provide a ladder if one is needed.
