A building permit is required prior to removing or abandoning a swimming pool or spa. For qualifying properties, the permit may be obtained during a quick visit to the Permit Center. 

Requirements Before Applying for a Building Permit

Meet the following requirements BEFORE you apply for the building permit:

BAAQMD Job Number is Required
Community Pools & Spas Require a Planning Clearance
Historical Properties Require a Planning Clearance
Other Planning Clearance May Be Required
Equipment Storage or Debris Box May Require a Permit

Who can apply? We recommend that the applicant be a licensed contractor. See Who Can Apply for a Permit for others who may apply. Whoever signs the building permit application is responsible and potentially liable for all activity under the permit. See Owner-Builders Beware!

SJPermits can help. At SJPermits.org, you can pay fees, schedule inspections, check the status of a permit, and find permit records and property information. An SJPermits account is required only if you are applying for an online permit or for projects that require Standard Plan Review.

Prepare the Permit Application Package

These instructions are only for projects going through Over-the-Service Service or Standard Plan Review Service.

Who can prepare plans? While some plans may be prepared by anyone, we recommend working with professionals. Inaccurate plans will require resubmittals and more fees. Accurate plans save time and money. See Plans That Require an Architect or Engineer.

> As appropriate to your type of property, provide:

Project Plans –  Use the plan instructions as appropriate to the type of property:
Single-Family & Duplex Projects - Plan Set Instructions
Plan Review Submittal Package - Commercial, Industrial, Multifamily

> Plot Plan - See plan example at the end of this page. On a minimum 18"x24" sheet, draw to scale and show:

  • Pool site and distances to property lines and to any structure on the site, including septic tanks. Label all structures. 

  • Non-Buildable Area - If the post-demolition area is to become non-buildable, delineate the non-buildable area and show dimensions. Indicate what replaces the pool or spa, e.g., landscaping.

  • Buildable Area - If the post-demolition area is to become buildable, you must provide:

    • Demolition, Drainage, and Compaction Plan plus a dimensioned Plot Plan prepared and wet stamped by a state-licensed engineer.
      > Be prepared to give a copy of the Compaction Plan and Plot Plan to the City inspector at time of inspection.

    • A completed Special Inspection Existing Building Form designating the supervising engineer or Special Inspection Agency who will conduct observation of the backfill compaction and provide a compaction report to the Building Division, declaring the abated area as buildable. 
      > Important: The Special Inspection Form is NOT required if the Engineer of Record (EOR) is performing the continuous special inspection. This must be stated on the plot plan.

  • Plan must be wet-stamped by the Engineer of Record (EOR), a California-licensed engineer.

> This project is subject to a refundable Construction and Demolition Diversion Deposit (CDDD). This deposit is collected at the time of permit issuance. 

IF APPLICABLE 

Owner-Builder Acknowledgement and Verification of Information Form - Submit if the property owner is the permit applicant.

> Documentation of any Planning clearances as outlined above.

How to Apply

Select the option that fits your project. Projects that do not qualify for Simple Projects Service or Over-the-Counter Service must use the Standard Plan Review Service.

Simple Projects Service - If demolition area will not be buildable
Over-the-Counter Service - If demolition area may be buildable
Standard Plan Review Service - For nonqualifying projects

Inspections

You will be issued a Permit Card that lists required inspections. Schedule inspections at SJPermits.org or call 408-535-3555 for assistance.

Be ready — read Inspection Success. Have ready for the inspector: 

  • A copy of the Plot Plan
  • If applicable, a copy of the Compaction Report
