Icon - Black outline of a window with four panesIf simply installing a retrofit window, a building permit is not required. However, a building permit is required prior to replacing a window when:

  • The window frame is altered, such as to handle damage repair or to lower the sill to comply with egress requirements. 
  • The window flashing is altered, including when removing the nailing fin.
  • The exterior wall finish is removed, such as when removing stucco to remove a window.
  • The property is on the City’s Historic Resources Inventory.

DEFINITIONS 

Window frame - Consists of the header, king stud, cripple stud, sill, and associated supports.

Window flashing - The thin material installed around a window frame to prevent moisture or wind from infiltrating the space between the window and exterior wall.

Retrofit window - A retrofit window is one that is installed within the existing opening with no alterations to the surrounding window frame or flashing. If the property is on the City's Historic Resources Inventory, then a retrofit window requires a permit.

How to Apply

Inspections

You will be issued a Permit Card that lists required inspections. Schedule inspections at SJPermits.org or call 408-535-3555 for assistance.

Be ready — read Inspection Success:

  • The Permit Card must always be on-site and available to the inspector. 
  • Have building plans and manufacturer instructions, if any, available.
  • Ensure there is access to all areas of the project work; provide a ladder if one is needed.
