Please note: Councilmember votes of interest for applicants are exempt from disclosure because they reveal the deliberations of government officials [Deliberative Process [California Government Code § 6255]].
On December 5, 2022, the City Council directed the opening of a recruitment to fill the unanticipated vacancies in Districts 8 and 10 by appointment. (City Charter Section 410)
Requirements for appointment, pursuant to City Charter Section 404.
- The person must have been a citizen of the United States for at least one year immediately preceding the commencement of the term for which the person is elected or the date upon which the person is appointed.
- The person must have been a resident of the City of San José and, excepting the Mayor, of the District represented by the person as member, for at least thirty (30) days immediately preceding the last day specified by law for the filing of nomination papers with the City Clerk for such office or, if appointed, preceding the date of the person’s appointment to fill a vacancy.
- If appointed to such office, the person must have been a registered elector of the City of San José at the time of the person’s appointment.
The incumbent must, at all times, during the term of office continue being:
- a citizen of the United States;
- a resident of the City of San José and, except as provided in Section 403, of the District which he or she represents; and
- a registered elector of the City
Councilmembers will be required to file quarterly income and time disclosures, disclosure of fundraising reports, Statement of Economic Interest upon application and annually. Councilmembers are also required to attend every Council meeting subject to a pay deduction for unauthorized absences. (City Charter 407 (e)) In addition to Council meetings, Councilmembers serve on Council Committees, regional boards and committees, and attend constituent meetings.
