District 3 Application Process for Interim Appointment

To apply for the District 3 interim appointment, you must fulfill the following requirements:
Eligibility Requirements Under City Charter Section 404:
1. The person must have been a citizen of the United States for at least one year immediately preceding the date upon which the person is appointed;
2. The person must have been a resident of the City of San José and of the District represented by the person as member, for at least thirty (30) days immediately preceding the date of the person’s appointment to fill a vacancy;
3. If appointed to such office, the person must have been a registered elector of the City of San José at the time of the person’s appointment.
The incumbent must, at all times, during the term of office continue being:
1. a citizen of the United States;
2. a resident of the City of San José District 3;
3. a registered elector of the City.
APPLICATION
THE APPLICATION PERIOD IS CLOSED.
Please submit your application no later than 12:00 PM on January 10, 2025. Your name and contact information, should you provide it, will be available publicly on the City Clerk website when you apply (list updated each City business day). All applications will be immediately transmitted to the City Attorney’s Office for a Conflict-of Interest check and to the Council along with a selection sheet indicating if the applicant has also filed nomination papers. The Councilmembers will have until Friday, January 17, 2025 to indicate which applicants they are interested in interviewing. Those applicants receiving four or more indications of interest will be invited to the Council meeting of January 28, 2025 to be interviewed as a panel in front of the Council. Please note: Councilmember votes of interest for applicants are exempt from disclosure because they reveal the deliberations of government officials [Deliberative Process [California Government Code § 6255]]. The Charter requires a simple majority to appoint, but Council may impose a higher requirement. The applicant selected to serve as the interim councilmember will receive their oath of office to begin their term on February 2, 2025 and to serve until a candidate has been duly elected and the results of the election have been officially certified.
