STATEMENT FROM THE INDEPENDENT POLICE AUDITOR 

The Office of the Independent Police Auditor (IPA) is aware of a use of force incident involving San José Police Department (SJPD) officers and an unhoused individual that reportedly occurred on or about March 10, 2025, in the area of Fruitdale Avenue and Leigh Avenue. Multiple media outlets have reported on the incident, and our office has received an outpouring of community complaints expressing concerns. We appreciate the community’s engagement and thank those who have taken the time to report their concerns. 

The SJPD has initiated a use of force investigation to assess whether the officers' actions were consistent with department policies and the law. Mayor Mahan’s office has contacted the IPA regarding this matter, and we have also been informed by the NAACP of concerns related to potential civil rights violations and excessive force.

The IPA's office is actively monitoring this case and will conduct a thorough review of the SJPD’s investigation to ensure it is complete, objective, and fair. This review will include, but is not limited to, analyzing all available evidence, video's (including body-worn camera video's), and participating in interviews of the involved officers.

Our office remains committed to transparency, accountability, and ensuring that all investigations into police conduct are conducted with integrity and fairness.
