SB 1383 Waiver Request
Senate Bill 1383 and San José Municipal Code require all San José businesses, institutions, and commercial properties to have organic waste service collection, also known as “Wet service,” with Republic Services.
Businesses, institutions, or commercial properties that generate minimal amounts of organic waste may qualify for a waiver exempting them from some or all of their Senate Bill 1383 requirements.

DE MINIMIS WAIVER (a.k.a. minimal generation of organic waste)
Eligibility Criteria
To qualify for a De Minimis Waiver, a business, institution, or commercial property must meet one of the following eligibility criteria:
- Generates more than two cubic yards of solid waste per week and less than 20 gallons of organic waste (food waste, food-soiled paper, and landscaping/plant waste) per week.
- Generates less than two cubic yards of solid waste per week and less than 10 gallons of organic waste (food waste, food-soiled paper, and landscaping/plant waste) per week.
