Infill Housing Ministerial Approval Ordinance
Addendum to the Envision San Jose 2040 General Plan EIR

This Ministerial Ordinance would streamline the review process for private housing applications in specified growth areas. As a ministerial process, development applications submitted under this Ordinance will not be subject to subsequent CEQA review. Developments coming in under this Ministerial Ordinance would be subject to all Zoning Code Development standards.
Development on sites with historic resources or cultural resources, designated farmland, protected wetlands, fire hazard zones, hazardous waste sites, earthquake zones, special flood hazard areas, habitat for protected species, and lands under a conservation easement would not be allowed under this ministerial review process.
LOCATION
To be eligible for this City Infill Housing Ministerial Approval Ordinance, project sites must be located:
- Within an approved urban village (excluding Alum Rock NBD Area Urban Village)
- Capitol Station Area Plan
- Jackson-Taylor Specific Plan
- Martha Gardens Specific Plan
- Midtown Specific Plan
- Rincon South
